(2) the City has given its final authorization to constructing the <br /> <br /> reali~ned Vineyard Avenue and associated improvements. <br /> <br />If the Property Owner transfers the property for the right-of-x~ ay and or <br />~ant easements, the City shall, at the request of Property Owner. take <br />such steps as may be necessary to return said property andor easements to <br />Property Owner in the event that Ii) neither PG&E nor the City move <br />forward with construction of the improvements or (ii) all necessary grants <br />of Vineyard Avenue right-of-wa> are not obtained by the Cit','. <br /> <br />Construction of improvements. <br /> <br />A. in the event PG&E facilities precede construction of the roadway <br /> improvements, City shall ensure that the full road~ ay rough grading shall <br /> be completed in conjunction with the PG&E project. <br /> <br />B. The City a~ees to fund construction of the roadway improvements and <br /> associated utilities listed in Exhibit C (the "Phase ~-~ Impruvements"l. The <br /> City shall make good faith efforts to ensure the timely construction of <br /> these improvements insofar as it is within its power to do so. The intent of <br /> the parties is to have these improYements completed by September I. <br /> 2003. <br /> <br />C.
