Code have been misconstrued or wrongly interpreted, <br /> the applicant may appeal from the decision of the <br /> director of building inspection to the city manager <br /> within thirty days from the date of the decision <br /> appealed. Such appeal shall be in writing and the <br /> city manager shall within thirty days of the <br /> receipt of the appeal and by written notice to the <br /> applicant either uphold, reverse or modify the <br /> decision of the director of building inspection. <br /> The decision of the city manager may be appealed <br /> within thirty days of said decision to the board of <br /> appeals established by Section 20.20.070 of this <br /> chapter. <br /> <br /> 20.20.070 Board of appeals - Established. <br /> <br /> There is created and established a board of <br /> appeals consisting of five members. Each member of <br /> the board of appeals shall be appointed by the <br /> council for a term of two years, provided that the <br /> first two members appointed shall serve a term of <br /> one year. The board shall elect a chairman. The <br /> director of building inspection or the director's <br /> representative shall be an ex-officio member of <br /> said board and shall serve as secretary. The board <br /> shall adopt reasonable rules and regulations for <br /> conducting its business. Any board of appeals <br /> appointed by the city council under the provisions <br /> of any other ordinance may act as the board of <br /> appeals provided for in this chapter when so <br /> directed by resolution of the city council. <br /> <br /> 20.20.090 Notification. <br /> <br /> A notice given by the board of appeals shall be <br />served personally or be sent by registered or <br />certified mail, postage prepaid, return receipt <br />requested, to the person owning the land on which <br />the building or structure is located, as such <br />person's name and address appear on the last <br />equalized a~e~sment roll, and to a mortgagee or <br />beneficiary under any deed of trust of record, at <br />the last known address of such mortgagee or <br />beneficiary; provided, that if the whereabouts of <br />such persons are unknown and the same cannot be <br />ascertained by the director of building inspection <br />in the exercise of reasonable diligence, and the <br />director of building inspection shall make an <br />affidavit to that effect, then said notice shall be <br />served by publishing same once a week for two <br />consecutive weeks in a newspaper published in the <br />city, and by posting said notice on the property <br />prior to the date of first publication.
