Except as shown on the tree removal <br />plan, no native trees adjacent to the retaining wall shall be removed. <br /> <br />Any sidewalk linking the central landscape/open space area between the buildings to the lake <br />shall be designed in a more natural configuration. The landscaping adjacent to said trail shall be <br />natural in appearance to better match the existing landscaping in the open space around the lake. <br />The final design of the trail links from the ring road to the lake and the adjacent landscaping shall <br />be shown on final site, grading, and landscape plans. Said plans shall be subject to the review <br />and approval by the Planning Director prior to issuance of building permits for the project. <br /> <br />In the event that the applicants receive permission from the applicable agencies to relocate the <br />existing portion of Sycamore Creek on the subject property, the applicants shall extend the cul- <br />vert on the west side of Sunol Boulevard to allow the 10 ft. wide Sunol Boulevard sidewalk to <br />continue as a separated sidewalk. Any relocated, re-created creek/riparian area within the north- <br />eastern open space area shall be subject to the review and approval by the Planning Director; said <br />modification shall conform in design to the new riparian area design located westerly of the ser- <br />vice road. <br /> <br />Rubberized or open-graded asphalt shall be utilized for the Sunol Boulevard street improvements <br />installed by the applicants. <br /> <br />Within four years of occupancy, the applicants shall reduce the number of peak hour employee <br />trips by 40% from the number of peak hour trips that would normally be generated if all em- <br />ployee trips were made in the peak hour by single-occupant vehicles. The applicants shall select <br />from the possible menu of programs listed in the "Applied Biosystems Transportation Manage- <br />ment Plan" on file with the Planning Department, or another program acceptable to the Planning <br />Director, to meet this 40% goal. The applicants shall submit to the Planning Director an annual <br />report showing significant progress to meet the 40% goal. Said plan shall be submitted every <br />year until the 40% trip reduction goal is met. Once the 40% goal has been reached, the appli- <br />cants shall maintain the transportation management program(s) then in place, or its equivalent, <br />and shall submit information to the Planning Director showing continued achievement of the <br />40% goal when requested. <br /> <br />The applicants shall repair as necessary and maintain the existing sanitary sewer line adjacent to <br />the Alameda County Transportation Corridor (ACTC), between the applicants' property and Ju- <br />nipero Drive. The sanitary sewer line shall be maintained to the satisfaction of the City Engi- <br />neer. Prior to occupancy, the project developer shall enter into an agreement with the City, ap- <br />proved by the City Attorney, which guarantees that the sanitary sewer line will be maintained at <br />all times in a manner consistent with City standards. The City shall have the right to maintain <br />the sanitary sewer line in a manner satisfactory to its standards should the property owners fail to <br />do so, and the City shall have the right to assess the applicants for any costs incurred in such <br />maintenance.
