Resolution No. PC-01-46 <br />Page 4 <br /> <br />9. The project developer shall obtain all building and other applicable City permits <br /> for the project prior to the commencement of construction. <br /> <br />10. Final inspection by the Planning Department is required prior to occupancy of the <br /> building. <br /> <br />Landscaping and Tree Preservation <br /> <br />11. <br /> <br />A final landscape plan and irrigation plan shall be submitted to and approved by <br />Planning Director as part of the building permit plan set prior to issuance of a <br />building or on-site permit. Said landscape plan shall be consistent with the <br />approved landscape plan plus any conditions of approval, and shall be detailed in <br />terms of species, location, size, quantities, and spacing. <br /> <br />12. <br /> <br />Prior to issuance of a building permit, the project developer shall submit a <br />demolition plan with the building plan set. The demolition plan shall clearly <br />indicate vegetation scheduled for demolition, proposed protection for landscaped <br />areas to be preserved, and the location of on-site materials storage. <br /> <br />13. <br /> <br />No trees shall be removed other than those specifically designated for removal on <br />the approved plans. The project developer shall post cash, letter of credit, or other <br />security satisfactory to the Planning Director in the amount of $5,000 for each tree <br />required to be preserved, up to a maximum of $25,000. This cash bond or <br />security shall be retained for one year following acceptance of public <br />improvements or completion of construction, whichever is later, and shall be <br />forfeited if the trees are destroyed or substantially damaged. <br /> <br />14. <br /> <br />All trees used in landscaping shall be a minimum of 15 gallons in size and all <br />shrubs a minimum of 5 gallons, unless otherwise shown on the approved <br />landscape plan. <br /> <br />15. <br /> <br />The project developer shall provide root control barriers and four-inch perforated <br />pipes for parking lot trees, street trees, and trees in planting areas less than ten feet <br />in width. <br /> <br />16. <br /> <br />Prior to occupancy, the project developer's landscape architect shall certify in <br />writing to the Planning Director that the landscaping has been installed in <br />accordance with the approved landscape and irrigation plans with respect to size, <br />number, species of plants, and overall design concept. <br /> <br />17. <br /> <br />The project developer shall enter into an agreement with the City, approved by the <br />City Attorney, which guarantees that all landscaping and open space areas <br />included in this project will be maintained at all times in a manner consistent with <br />the approved landscape plan for this development. Said agreement shall run with <br />the land for the duration of the existence of the structures located on the subject <br />property. <br /> <br /> <br />
