Resolution No. PC-01-26 <br />Page 6 <br /> <br />General Planning Conditions <br /> <br />24. <br /> <br />The project developer shall use their best efforts to implement the measures <br />identified in the U.S. Green Building Council's (GBC), "Leadership in Energy and <br />Environmental Design (LEED)" 2.0 rating system in the design, construction, and <br />operation of the proposed building, including all future tenant improvements. <br />These measures shall be shown on the building permit plan set submitted for review <br />and approval before issuance of a building permit. In conjunction with the building <br />permit application, the project developer shall determine the building's "LEED <br />Green Building Rating", using the GBC evaluating methodology, and shall report <br />the rating to the Planning Director before issuance of the building permit, which <br />shall be reported to the Planning Commission. Prior to building permit issuance, <br />the green building provisions that are proposed to be included in the development <br />shall be submitted to the Planning Director for review and comment. City staff <br />shall arrange a meeting with the project developer to discuss the proposed measures <br />and to determine if other feasible, mutually agreeable green building measures can <br />be incorporated into the project. <br /> <br />25. <br /> <br />Prior to issuance of a building permit, the elevation drawings shall be modified to <br />show solar glazing and/or tinting on the playplace windows on the north and east <br />elevations of the building. The type and amount of tinting shall be subject to <br />review and approval by the Planning Director. <br /> <br />26. <br /> <br />A minimum of one family-style restroom shall be provided in the public restroom <br />facility on site. The Planning Director shall approve the design of the bathroom <br />prior to issuance of a building permit. <br /> <br />27. <br /> <br />The owner/operator of the McDonald's restaurant covered by this approval shall be <br />responsible to the larger community for any trash generated from this project. <br />Before issuance of an occupancy permit, McDonald's shall initiate a discussion <br />with the East Bay Regional Park District regarding potential McDonald's trash in <br />Shadow Cliffs park. Said discussions shall be reported to the Planning Director by <br />McDonald's. McDonald's shall also investigate means to assist in trash clean-up, <br />e.g. in the parks, adjacent properties, public rights-of-way, etc. <br /> <br />28. <br /> <br />In conjunction with its building permit review, McDonald's shall compare this <br />facility to its Antioch facility with respect to energy efficiency, LEED measures, <br />integration of McRecycle USA recycled products, etc. The results of this <br />comparison shall be reported back to the Planning Commission. <br /> <br />29. <br /> <br />If the operation of the drive-through restaurant results in conflicts pertaining to <br />parking, noise, traffic/circulation, litter, odors, loitering, or other impacts, at the <br />discretion of the Planning Director, this design review approval may be referred to <br />the Planning Commission for subsequent review at a public hearing. <br /> <br />30. Prior to issuance of a building permit, the building planset shall show the location <br /> and size of recycling bins proposed for use at all trash corrals on the site. <br /> <br /> <br />
