Resolution No. PC-01-17
Page 12

maintained at all times in a manner consistent with the approved landscape plan
for this development. Said agreement shall run with the land for the duration of
the existence of the structures located on the subject property.

34.

The developer shall comply with the recommendations of the tree report prepared
by HortScience dated July 2000 and September 25, 2000, incorporated herein by
reference. No tree trimming or pruning other than that specified in the tree report
shall occur. The developer shall arrange for the horticultural consultant to
conduct a field inspection prior to issuance of building permits to ensure that all
recommendations have been properly implemented. The consultant shall certify
in writing that such recommendations have been followed.

35.

The applicants may remove the two trees (Nos. 27 and 52) specified in the tree
report prepared by HortScience dated July 2000. The applicants shall mitigate
removal of these trees at a 6:1 ratio for each tree. Replacement trees shall be
native species planted in the general vicinity of the removed trees. Replacement
trees shall be a combination of 15 gallon, 24 inch, and 36 inch box size trees. A
tree replacement plan shall be submitted for review and approval by the Planning
Director prior to removal of the trees.

36.

Prior to issuance of a grading or building permit, the applicants shall secure an
appraisal of the replacement value of all trees included in the tree report affected
by the development which are required to remain. The appraisal shall be
performed in accordance with the current edition of the "Guide for Plant
Appraisal" under the auspices of the International Society of Arboriculture. The
appraiser shall be subject to the Planning Director's approval.

37.

Except as allowed by Condition No. 33 above, no trees shall be removed from the
site. The applicants shall be responsible for the loss of any tree not previously
approved for removal. For trees which are removed during construction, the
applicants shall pay a fine in the amount equal to the appraised value of the
subject tree. The applicants shall post cash, letter of credit, certificate of deposit
(CD), or other security satisfactory to the Planning Director in the amount of
$5,000 for each tree required to be preserved, up to a maximum of $25,000. This
cash bond or security shall be retained for one year following completion of
construction and shall be forfeited if the trees are removed, destroyed, or
disfigured. If the fine based on the appraised value of the tree(s) exceeds the bond
amount, the applicants shall pay the difference between the bond and the
appraised value of the subject tree(s).

38.

The following tree preservation methods shall be followed during construction of
the site. These methods shall be listed on the building permit plans and shall
include, but not be limited to, the following:

a. No existing tree may be trimmed or pruned without prior approval by the
Planning Director. Any City approved pruning of existing trees shall be
performed by a certified arborist.
