10. <br /> <br />Lin/Lonestar/Simoni," including Parcel "B," "D," and "F" plans (denoted <br />as pages SPloSP4). <br />A vineyard as depicted in the overall Avignon MDR plan for Parcel "C" <br />shall be added to the Parcel "B" vineyard ownership and maintenance if its <br />establishment is allowed by the agencies with jurisdiction over the riparian <br />corridor of Parcel "C." <br />The maintenance agreement between Centex Homes and Wente, <br />incorporated herein by reference, shall be followed for the duration of its <br />term. Following its term, the vineyards shall be continuously maintained <br />in a manner consistent with best industry management practices for an <br />operating vineyard, including continued use of "Integrated Pest <br />Management" plans. <br />Should proposed modifications to the vineyard plans be recommended by <br />the City's peer reviewer, such modifications shall be incorporated into <br />these conditions and shall be followed as if part of the above-referenced <br />plans. <br />Any change to the viticulture use shall first require a finding by the <br />Planning Commission that continued viticulture is infeasible and shall <br />require Planning Commission approval of the proposed new agricultural <br />use. <br /> <br />Agricultural easements covering the non-building envelope areas of the vineyard <br />estate lots in favor of the City, as grantee, and the South Livermore Valley <br />Agricultural Land Trust, as third party beneficiary, shall be recorded with the first <br />final map for this project. The easements shall be substantially similar to the draft <br />easement shown in attachment #9 of the staff report, incorporated herein by <br />reference. Final approval of the easement language shall be required by the City <br />Attorney prior to recordation of the final map. <br /> <br />The owner/operator of the vineyard of Parcel "B" shall notify the public school of <br />any pesticide/herbicide spraying twenty-four (24) hours before the spraying <br />begins. <br /> <br />The owner/operator of the vineyard areas and their consultants shall work with the <br />Planning staff to determine the feasibility of incorporating the University of <br />California, Davis Campus, "Statewide Pest Management Program Guidelines" <br />into the maintenance and operation of the vineyard areas. In this context, the <br />vineyard owner/operator is encouraged to examine the CCOF Handbook from an <br />organic practices and list of materials standpoint to minimize the use of chemicals <br />in the vineyard area. The developer shall prepare an analysis for review by the <br />Planning Commission with the tentative map of the combined pest management <br />program described above, with emphasis on what organic farming measures can <br />be included, which chemicals would be allowed, and which chemicals would be <br />prohibited. <br /> <br />P~e9 <br /> <br /> <br />
