33. That the final development plan(s) for any portion of the <br /> site shall include preliminary design plans, elevations, <br /> materials, and colors for the dwelling units proposed on the <br /> site, to be reviewed and approved by the City. In addition, <br /> the plan(s) shall indicate the proposed phasing schedule and <br /> shall clearly depict those lots which are proposed for custom <br /> home development. <br /> <br />34. That all main structures to be built on lots designated for <br /> custom home development within the project shall be subject <br /> to review and approval by the Design Review Board prior to <br /> the issuance of a building permit. <br /> <br />35. That, prior to the submittal of a final development plan for <br /> any portion of the site, the developer shall work with staff <br /> to revise the design guidelines and site development <br /> standards. Said revisions shall reflect the comments made on <br /> pages 2 and 3 of the Planning Commission staff report <br /> (addendum) dated March 8, 1989, and any other conditions <br /> referenced herein. <br /> <br />36. That all areas depicted on the final grading plan as being <br /> "graded to daylight" shall be rounded and not left with any <br /> abrupt cut or fill slopes. <br /> <br />37. That the final grading plan shall identify the approximate <br /> locations of the private driveway accesses for all sloping <br /> lots in the development. <br /> <br />38. That the developer shall install a 5-foot, separated, public <br /> sidewalk along the east side of Foothill Road from the <br /> northwest corner of the site to Muirwood Drive South, as <br /> required in the Laguna Oaks Specific Plan. The design and <br /> configuration of the sidewalk shall be subject to review and <br /> approval by the Planning Director and City Engineer. The <br /> sidewalk shall be completely installed in conjunction with <br /> the first phase of any development in Land Unit A. <br /> <br />39. That the developer shall be responsible for the dedication of <br /> land for the approximately 4-acre Alviso Adobe public park at <br /> the time of the first final map for Unit A or any portion <br /> thereof, or when otherwise deemed necessary by the City. <br /> <br />40. That the developer shall be responsible for the dedication, <br /> design and improvements for the areas shown as "Community <br /> Open Space and Trail Improvements" in the Laguna Oaks <br /> Specific Plan (the public open space areas adjacent to the <br /> Arroyo de la Laguna property and between the 5-acre public <br /> park and the northwest corner of the site). Said <br /> improvements shall be installed in conjunction with the <br /> installation of the streets in each area, as specified in an <br /> approved phasing plan to be submitted for approval at the <br /> time of the final development plan submittal(s). <br /> <br /> <br />
