46. The applicant's engineer shall verify that the capacity of the <br /> existing storm drain culverts under Foothill Road and Dublin <br /> Canyon Road are adequate to handle the run-off from this pro- <br /> posed development. The applicant shall mitigate any storm <br /> drain problem associated with this development to the satisfac- <br /> tion of the City Engineer. <br /> <br />47. The applicant shall use its best efforts to acquire the neces- <br /> sary access easement from the adjacent Panganiban property for <br /> the paved roadway to the water reservoir site. Should the <br /> applicant be unable to acquire said easement, the City may use <br /> its right of eminent domain. The applicant shall reimburse to <br /> the City any cost incurred in the easement acquisition. <br /> <br />48. Access to the adjacent Quiet Valley Ranch property to the west <br /> shall be maintained at all times during construction. The <br /> applicant shall submit a plan for City approval prior to issu- <br /> ance of a grading permit showing how access will be main- <br /> tained. <br /> <br />49. All driveways shall be private and maintained by the owners <br /> that use these driveways. This condition shall be recorded on <br /> the face of the deed of those affected lots and the project <br /> C.C.R's. <br /> <br />50. The applicant shall negotiate in a good faith effort to acquire <br /> the necessary street right-of-way for the transition lane <br /> needed along Foothill Road across the adjacent property to the <br /> south, as stated in Condition No. 39. Should the developer be <br /> unable to acquire said right-of-way, the City may use its right <br /> of eminent domain. The developer shall reimburse to City any <br /> cost incurred in the right-of-way acquisition. <br /> <br />51. There shall be parking on "A" Street only on the side of the <br /> street that development occurs. The applicant shall post the <br /> other side of the street for no parking. <br /> <br />52. The driveway for corner lots shall front on the minor street or <br /> cul-de-sac. <br /> <br />53. "A" Street shall be raised near the Laurel Creek bridge to <br /> reduce the maximum depth of the sanitary sewer line on "A" <br /> Street south of the bridge. The applicant shall work with <br /> staff to achieve an appropriate balance between the depth of <br /> the sewer and the height of the bridge, subject to the approval <br /> of the City Engineer. <br /> <br />54. All sanitary sewers and laterals shall be designed to flow by <br /> gravity. <br /> <br />55. All landslides in undeveloped areas that are not a hazard to <br /> the development shall be left natural and should not be re- <br /> paired. <br /> <br />Rev. 6/19/90 <br /> -21- <br /> <br /> <br />
