8. The applicant shall abide by the recommendations of the Tree <br /> Report, dated November 16, 1990. Proper construction methods <br /> shall be utilized by the applicant to ensure that every <br /> feasible measure is taken to protect the trees designated to <br /> be saved on the development plan. <br /> <br />9. The applicant shall offer to grant an easement or fee for the <br /> public access over and use of the upland open space on the <br /> project site for recreational purposes. The Parks and <br /> Recreation Commission shall recommend to the City Council <br /> prior to approval of the final map whether to accept such an <br /> easement or fee. The City and the applicant shall work <br /> together to seek mutually satisfactory resolutions to issues <br /> of joint concern, including access points, liability issues, <br /> hours of use, intensity of use, and the nature and extent of <br /> the public's interest in the property. <br /> <br />10. Lots 1,2,3,and 4 shall be reconfigured into 3 lots that <br /> comply with the site development standards of the West <br /> Foothill Road Corridor Overlay District. <br /> <br />11. Lots 5 and 6 shall be combined into one lot. <br /> <br />12. The applicant shall install a traffic signal subject to the <br /> approval of the City Engineer at the Highland Oaks Drive and <br /> Foothill Road intersection. These improvements shall be <br /> shown on the tentative map. <br /> <br /> 13. A wild fire management plan for all of the open space area <br /> shall be submitted for approval by the Fire Department prior <br /> to recordation of the final map. <br /> <br /> 14. The project CC&Rs shall include the restrictions governing <br /> the use of the common open space areas as outlined in the <br /> Final EIR. These measures include the prohibition of <br /> herbicide in areas adjacent to Heritage Trees, the <br /> prohibition of vehicles and open fires, and the maintenance <br /> and replacement of landscaping in these area. <br /> <br /> 15. The homes to be constructed on the east side of the <br /> foreridge, commonly referred to as East Ridge, shall not be <br /> any greater in height than the trees which are to be planted <br /> on the top of that ridge. This height shall not exceed the <br /> height of the trees at the time they are planted on the <br /> ridge. <br /> <br /> 16. "E" Street and "F" Court where they parallel the fault may be <br /> required to be shifted easterly to clear the fault shear <br /> zone. Prior to tentative map approval, further study of the <br /> shear zone of the fault shall be made to determine its <br /> suitability as a road base.
