EXHIBIT "A" <br /> Ordinance 1469 <br /> CONDITIONS OF APPROVAL <br /> PUD-89-13 <br /> <br />1. The development shall conform substantially to the plans on <br /> file with the Planning Department, Exhibit A, dated June 14, <br /> 1990, except as may be modified by the following conditions <br /> of approval. <br /> <br />2. That the principal structures to be located on Lots 48 and <br /> 49 shall maintain a minimum distance of 200 feet at their <br /> closest points. <br /> <br />3. The applicant shall receive Design Review Board approval of a <br /> final landscape plan which complies with the West Foothill <br /> Road Corridor Overlay ordinance prior to recordation of the <br /> final map. This landscape plan shall contain predominantly <br /> drought resistant landscaping materials. <br /> <br />4. The applicant shall construct a retaining wall outside of the <br /> dripline of the Heritage Tree on Lot 28 to prevent the <br /> placement of fill from the roadway construction within the <br /> dripline. In the event that this tree should perish, the <br /> applicant shall replace this tree with an equivalent sized <br /> tree. <br /> <br />5. Proposed lots 1,5-12,14,16-17,26-34, and 49-50, if all <br /> approved, shall have homes which are designed with adequate <br /> ventilation/air conditioning under closed window conditions <br /> in order to reduce the interior noise level to 45 dBA Ldn or <br /> less. The siting of the houses on these lots shall be done <br /> in such a way as to shield the outdoor rear yard living areas <br /> from the noise source. <br /> <br />6. The applicant shall receive Design Review Board approval of <br /> the final design for the common recreational area prior to <br /> recordation of the final map. <br /> <br />7. In the event the City Engineer requires "E" Street to be <br /> relocated easterly, the applicant shall submit a revised <br /> configuration for Lots 35-39 that reflects the reduction in <br /> the lots' sizes due to the revised roadway alignment. This <br /> reconfiguration may result in the reduction of the total <br /> number of lots within this area. The applicant shall provide <br /> a cross-section for each of these lots that illustrates that <br /> the homes which will be located on these lots will not be <br /> visible above the foreridge from Foothill Road. Final <br /> approval of these lot configurations shall be made by the <br /> Planning Commission in conjunction with review of the <br /> tentative map. <br />Rev. 6/19/90 <br /> -1- <br /> <br /> <br />
