into an agreement which, in the view of the City Attorney, <br /> appropriately protects the City from landslide and subsidence <br /> claims which may arise as a result of building this project <br /> on a hillside location. <br /> <br />49. Street lighting shall be provided by the developer and shall <br /> be designed to minimize intrusion of hillside lighting to the <br /> valley floor. The lighting system shall be approved by the <br /> City Engineer and Planning Director. The street lights on <br /> the private courts shall be maintained by the individual <br /> property owners fronting on those streets. <br /> <br />50. The deed restrictions for each lot shall indicate to <br /> potential buyers the responsibility of the owners for <br /> maintenance and repair of all common areas, private courts, <br /> and storm drain systems. <br /> <br />51. The private courts and private utility systems on the project <br /> site shall be owned, maintained, and repaired and operated by <br /> the Homeowners Association. <br /> <br />52. The roadways designated on the plans as "Emergency Access <br /> Road" shall have a maximum grade of 15 percent and have a 20 <br /> feet paved travel width, satisfactory to the Fire Marshal and <br /> Director of Public Works. These roads shall be designed to <br /> provide adequate emergency access from the end of the private <br /> courts to the rear property line of the westernmost lot on <br /> the respective courts. The final design of these roadways <br /> shall be included in the tentative map submittal. <br /> <br />53. The private courts as shown on the development plan shall be <br /> constructed with 6 in. vertical concrete curb and gutter <br /> unless otherwise approved by the City Engineer. No parking <br /> shall be allowed on the street. The developer shall take <br /> such steps as are necessary to allow City enforcement of <br /> parking and other traffic rules and regulations. <br /> <br />54. The applicant shall show on the tentative map any proposed <br /> phasing of the project. <br /> <br />55. The applicant shall mitigate the conditions of unstable <br /> slopes and landslides. Such mitigation shall include the <br /> following: <br /> <br /> a. All landslides shall be identified, mapped, and <br /> catalogued by a geotechnical engineer and certified <br /> engineering geologist prior to tentative map approval. <br /> <br /> b. The depths and lateral dimensions of all bedrock <br /> landslides and large surficial slides shall be <br /> determined by surface and subsurface methods that <br /> include drilling and/or trenching. <br /> <br />Rev. 6/19/90 <br /> -7- <br /> <br /> <br />
