and easement acquisition costs, of a system deemed <br /> satisfactory by the City Engineer should it develop in <br /> advance of these properties. Pro rata reimbursement from <br /> other benefitting properties will be allowed if the adopted <br /> system is a permanent facility; in the event the project <br /> utilizes water system improvements installed by others, it <br /> shall reimburse those installing the improvements in <br /> accordance with its pro rata share. <br /> <br />40. The applicant shall install a water main in Foothill Road <br /> between Highland Oaks Drive and West Las Positas Boulevard as <br /> called for in the City's water master plan. The water main <br /> size will be determined by the City Engineer in conjunction <br /> with the approval of the tentative map. The City may <br /> consider reimbursement for oversizing the line. <br /> <br />41. The Sorensen property shall be surveyed and included within <br /> the boundary of the subdivision map. <br /> <br />42. The storm drain in the open space lot in the northeast <br /> quadrant shall be relocated to the public street. <br /> <br />43. The sanitary sewer in the open space area between "B" Street <br /> and Foothill Road shall be relocated, the sanitary sewer <br /> shall remain in "B" street to Foothill Road. <br /> <br />44. The sanitary sewer in "C" Street between "E" Street and the <br /> southerly end of "C" Street shall be relocated. From the <br /> intersection of "E" Street, the sanitary sewer shall flow <br /> northerly in "C" Street to "A" Street. <br /> <br />45. "I" Court shall be reconfigured to a driveway configuration <br /> to avoid off-set street openings not meeting City standards. <br /> <br />46. The existing parcel west of the developed area (Sorensen) <br /> shall be granted an easement over "I" Court to provide <br /> access. Access to the Sorensen property shall be maintained <br /> at all times during construction. The applicant shall submit <br /> a plan to the City Engineer for approval showing how access <br /> will be provided during construction prior to the issuance of <br /> a grading permit. <br /> <br />47. No individual access driveways shall be allowed from any of <br /> the project lots onto Foothill Road. <br /> <br />48. The Homeowners Association shall enter into an agreement to <br /> hold harmless, defend and indemnify the City, its officers <br /> and employees from any cause of action or claim for damage or <br /> injury caused by the private roadways, or private drainage <br /> systems, or their maintenance and upkeep, or caused by the <br /> party contracted with for maintenance services, and the <br /> CC&R's shall make each homeowner chargeable for costs related <br /> to responsibilities provided for in this condition; and, <br /> prior to approval of the final map, the developer shall enter <br />Rev. 6/19/90 <br /> -6- <br /> <br /> <br />
