e. Maintain on-site storm sewer lines, sidewalks, driveway, <br /> parking spaces, and driveway approaches to private <br /> garages. Private water lines, sanitary sewer lines, <br /> sideyards, and buildings shall be maintained by the <br /> respective property owner. <br /> <br /> f. The Declaration of CC&R's shall state that if the <br /> Homeowners Association fails to maintain any of the <br /> landscape conditions stated above, the City shall have <br /> the right to enter onto the property, after prior notice <br /> to the Association to enforce these landscape <br /> maintenance responsibilities and shall bill the <br /> Homeowners Association for all associated costs. <br /> <br />6. The applicant shall provide a final grading plan and site <br /> plan, for review and approval by the Director of Planning and <br /> City Engineer, prior to issuance of a building permit. The <br /> grading and/or engineering/utility plan shall include the <br /> following items: <br /> <br /> a. The applicant shall eliminate the retaining wall to be <br /> located opposite lots three, four, five, and six. <br /> Natural grade shall be maintained up to the driveway <br /> curb at this location. The applicant shall reduce the <br /> height of the retaining wall to be located opposite lots <br /> one and two to a maximum height of 3'. <br /> <br /> b. The on-site storm drainage, water, and sanitary sewer <br /> systems for this development shall be private systems. <br /> The storm drain system shall consist of a storm drain <br /> line from the catch basin on Division Street to the <br /> Arroyo del Valle shall be relocated to the satisfaction <br /> of the City Engineer to run in Division Street and in <br /> the private street to the Arroyo del Valle. This line <br /> shall be a public system maintained by the City. The <br /> developer shall dedicate a 15' wide Public Service <br /> Easement (PSE) over the line through the development. <br /> It is the City's intent that each individual property <br /> have its own water service and sewer lateral. <br /> <br /> c. The applicant shall resurface Division Street to the <br /> ~atizfaction of the City Engineer after the installation <br /> of utilities to the subject project. <br /> <br /> d. The applicant shall pay its proportional share of the <br /> costs to underground the overhead utility systems along <br /> the Division Street project frontage. The amount of the <br /> contribution shall be finalized by the Director of <br /> Planning and City Engineer and shall be due and payable <br /> to the City at the time the final map is submitted for <br /> signature. <br /> <br /> -6- <br /> <br /> <br />
