6. The proposed house siting plan for Lot 1 does not conform to <br /> the front yard setbacks established in the proposed design <br /> guidelines, thus is not approved as part of this project. <br /> Any house sited on this lot shall conform to the setbacks <br /> established in the design guidelines or as shown on Exhibit <br /> C. <br /> <br /> 7. The applicant shall submit a fence plan for the southern <br /> property line for the review and approval by the Planning <br /> Director prior to the approval of a minor subdivision for <br /> the property. This plan shall illustrate which existing <br /> fences shall be removed and the location of the new fencing <br /> to be installed. The applicant shall meet with the <br /> neighbors regarding this fencing, with the goal being <br /> consolidation and replacement as needed of fencing between <br /> the subject property and the Rosepointe lots. The developer <br /> shall pay for the entire cost of this proposed fencing and <br /> its installation. <br /> <br />8. The applicant shall install the landscaping along the entire <br /> southern property line as shown on the attached landscape <br /> plan, "Exhibit A", prior to the occupancy of any of the <br /> residences on any of the three lots. The remainder of the <br /> landscaping shall be installed within one year of occupancy <br /> of the house on Lot 2. <br /> <br />9. All of the existing trees on the southern property line, as <br /> well as new trees planted in this area, shall be retained. <br /> None of these trees may be removed without the approval of <br /> the Planning Director. These restrictions shall be recorded <br /> with the deed for each of the properties and proof of the <br /> recordation of the deed restriction shall be provided to the <br /> Planning Department prior to the issuance of building <br /> permits for the respective lot. <br /> <br />10. The applicant shall follow all of the recommendations of the <br /> tree report for the protection of the existing trees shown <br /> to be saved on the attached grading plan. The applicant. <br /> shall have an arborist present on the site at the <br /> commencement of grading for the structure to be located on <br /> Lot 2 to ensure that all the necessary precautionary <br /> measures have been implemented. The applicant shall also <br /> notify the Planning Department of the commencement of <br /> grading. Upon the completion of the site grading and the <br /> foundation construction, the arborist shall provide a report <br /> to the Planning Department which outlines the health of the <br /> trees subsequent to the construction and the extent of <br /> damage to the trees, if any, caused by the construction. <br /> This final report shall be submitted to the Planning <br /> Department prior to the final occupancy of the structure. <br /> <br />11. The cul-de-sac shall be a private street. <br /> <br /> 15 <br /> <br /> <br />
