With the tentative map, the City will determine the <br /> open space ownership and, therefore, maintenance <br /> responsibility, either by a homeowners association <br /> or by such other mechanism approved by the City to <br /> enable a landscape and lighting maintenance <br /> district to be established. With the tentative <br /> map, an open space maintenance plan shall be <br /> reviewed. Visual and biological concerns and <br /> effects and provisions for on-going maintenance <br /> shall be identified and incorporated into the plan.. <br /> With this mitigation measure identified and <br /> incorporated into the project by reference, the <br /> impact has been reduced to a less than significant <br /> level. <br /> <br />Findings: <br /> <br />1. The City Council finds that the project as proposed <br /> and subsequent development of the project site will <br /> alter the existing land use pattern and said <br /> alteration is an insignificant adverse land use <br /> impact. <br /> <br />2. The City Council finds that the project's <br /> residential use, density, and holding capacity <br /> conforms to the City's General Plan. <br /> <br />3. The City Council finds that the mitigation measures <br /> generally noted on Table 3-3 of the Final EIR which <br /> are required for specific environmental impacts <br /> covered in other chapters of the Final EIR are <br /> feasible to implement. <br /> <br />4. The City Council finds that the mitigation measures <br /> generally noted on Table 3-3 of the Final EIR which <br /> are required for specific environmental impacts <br /> identified in other chapters of the Final EIR have <br /> been incorporated in the project either by design <br /> or by reference in the conditions of approval. <br /> Therefore, any General Plan policy or program <br /> inconsistency has been mitigated to a level of <br /> insignificance with the project, or will be <br /> mitigated to a level of insignificance in <br /> connection with the future approvals necessary for <br /> development of the site. <br /> <br /> - 3 - <br /> <br /> <br />
