o that such changes or alterations are within the purview <br /> and jurisdiction of another public agency and have been <br /> or should be adopted by that agency; or <br /> <br />o that specific economic, social, or other considerations <br /> make infeasible the mitigation measures or project <br /> alternatives identified in the Final EIR. <br /> <br />Pursuant to CEQA Guidelines Section 15091, the City Council <br />finds and makes the following findings for each significant <br />environmental impact of the above-referenced project. <br /> <br />A. Land Use and Planning <br /> Impacts: <br /> <br /> 1. The City finds that the 149 unit development plan, <br /> as initially proposed by the applicant, would <br /> exceed the project site's holding capacity of 118 <br /> units, using the General Plan's average densities. <br /> This is a potential significant planning impact <br /> (Final EIR, page 3-5). <br /> <br /> 2. The City finds that the 149 unit development plan, <br /> as initially proposed, is potentially inconsistent <br /> with General Plan policies and programs that guide <br /> urban growth and development or which have a <br /> bearing on the project's physical design (Final <br /> EIR, pages 3-6 through 3-9). <br /> <br /> 3. The City. finds that approval of the 149 unit <br /> development plan without resolution of the <br /> ownership and management of project open space is a <br /> potential significant impact (Final EIR, page 3- <br /> 14). <br /> <br /> Facts: <br /> <br /> 1. The 107 unit development plan is under the general <br /> plan holding capacity of 118 units for this site. <br /> The project is now consistent with the property's <br /> pro-rata share of the General Plan holding <br /> capacity. There is now no significant adverse <br /> impact and no land use mitigation is required. <br /> <br /> 2. Table 3-3 on pages 3-7 through 3-10 of the Final <br /> EIR recommends consistency measures reflected in <br /> the mitigation measures recommended in Chapters 3, <br /> 4, 5, and 9 of the Final EIR. Findings addressing <br /> these mitigation measures are covered in the <br /> subsequent sections of this report. These <br /> mitigation measures are incorporated in the project <br /> <br /> - 2 - <br /> <br /> <br />
