Homesites which have received Design Review Board approval- <br /> prior to approval of PUD-SS-15-2M have included <br /> reforestation and s=ree~ trees on their individual landscape <br /> plans. The developer's landscape architect shall include <br /> these trees on the tract reforestation and street tree plans <br /> to be submitted to the City. <br /> <br />2. A legal document shall be prepared between the. developer and <br /> all Golden Eagle Farm property owners. This document-shall <br /> include a statement of Condition No. 7 of this approvaa~and <br /> an explanation of the reason for the document. The City <br /> shall approve this document for content prior to its use and <br /> shall receive a copy of each agreement between the developer <br /> and each property owner. <br /> <br /> 3. The document shall include a list of prices for furnishing <br /> and planting (materials and labor) each species and size of <br /> tree to be planted on each lot. This list shall be prepared <br /> by the developer, subject to City review and approval. <br /> <br /> 4. The document shall re~uire that the property owner <br /> lot affected by this condition notify the developer at--least <br /> 45 days prior to occupancy of the expected date of <br /> occupancy. Within 30 days of receipt of such notice, the <br /> developer shall make arrangements with the property owner <br /> for planting the trees or providing other compensating <br /> measures, as specified in #5, below. <br /> <br /> 5. Arrangements between the homeowner and developer regarding <br /> the reforestation and street tree planting shall include one <br /> of the following, as applicable: <br /> <br /> A. The developer provides and installs the trees. <br /> <br /> B. The developer provides the trees and the homeowner <br /> plants them. <br /> <br /> C. The developer pays the homeowner the cost of the trees <br /> and the homeowner purchases and installs them. <br /> <br /> <br />
