Any such tree transplanting shall be shown on the <br /> plan referenced in Condition Number 1 and shall be included <br /> in the security required in condition Number 2. <br /> <br />5. The Design Review Board shall be directed to give highest <br /> priority to the design of houses on these visually-sensitive <br /> lots in order to ensure the goal that the houses blend into <br /> the hillside, wooded setting. <br /> <br />6. A legal document, acceptable to the City Attorney, shall be <br /> prepared defining specifically how the homeowner and the <br /> developer shall interact as to planting of the reforestation <br /> and street trees on that lot should the homeowner proceed <br /> before the developer. Cost, purchasing, and equitable <br /> compensation shall be addressed in said document. No <br /> occupancy shall be allowed on a lot until reforestation is <br /> completed, although construction may begin before the <br /> reforestation is completed. The legal document shall be <br /> consistent with the program specified in Attachment 1. <br /> <br /> <br />
