In cases where there is a disagreement between the developer <br /> and property owner as to cost,~ timing of planting, or other <br /> related issue, the City shall mediate and attempt to resolve <br /> the issue in a mutually beneficial manner. <br /> <br />7. The developer shall provide the City with a status letter <br /> for each lot stating when the required trees were planted <br /> and/or the property owner reimbursed, as applicable. <br /> <br />8. The developer shall prepare a disclosure statement for each <br /> owner or potential owner of each of the twenty impact lots <br /> stating the requirement for three additional (for a total of <br /> six) 36-inch box trees to be planted by the property owner <br /> at the developer's cost. <br /> <br />9. The developer will rebate $2,000 to each lot owner of one of <br /> the twenty impact lots who has closed escrow (Lots 20, 22, <br /> 23, 24, 26) to cover the planting of the three additional <br /> trees. This rebate will be issued within 30 days of the <br /> homeowner notifying the developer in writing of building <br /> permit issuance. <br /> <br />10. The developer will credit $2,000 to each lot buyer of one of <br /> the twenty impact lots with an open escrow for the cost of <br /> planting the three additional 36-inch box trees. <br /> <br /> <br />
