The present driveway onto Foothill Road from the project <br /> site shall be demolished after the new access road is <br /> completed. There shall be no individual driveways or access <br /> allowed onto Foothill Road. The Parcel Map shall reflect <br /> this condition. <br /> <br />34. Street lighting shall be provided by the developer and shall <br /> be designed to minimize intrusion of hillside lighting to <br /> the valley floor to the satisfaction of the Planning <br /> Director. The lighting system on the private road shall be <br /> approved by the Planning Director and City Engineer, <br /> installed by the developer and maintained by the homeowners' <br /> association. <br /> <br />35. All of the lot owners in this development shall create and <br /> participate in a legal entity responsible for the <br /> maintenance and repair of the entire length of the private <br /> road that serves this deve~iopment. This length shall extend <br /> from its entrance from Foothill Road to its terminus near <br /> the southern property line of this development (Ku). All <br /> parties utilizing this roadway (except Kliment as specified <br /> in the conditions of approval for PUD-88-16) shall <br /> participate in this entity. This entity shall enter into an <br /> agreement to hold harmless, defend and indemnify the City, <br /> its officers and employees from any cause of action or claim <br /> for damage or injury caused by the private roadways, or <br /> private utility systems, or their maintenance services, and <br /> the party contracted with for maintenance services, and the <br /> CC&R's shall make each homeowner chargeable for costs <br /> related to responsibilities provided for in this condition. <br /> All lots located in the other subdivisions that utilize this <br /> private street shall be granted reciprocal access easements <br /> over the portion of the street which is located within this <br /> development. <br /> <br />36. The applicant shall dedicate with the Parcel Map to the City <br /> for street right-of-way purposes across the full frontage of <br /> the site sufficient area to accommodate a 4 lane Foothill <br /> Road with median island as described in the General Plan. <br /> This right-of-way shall be based on the 1990 Foothill Road <br /> Alignment Study, and shall include all necessary easements <br /> for slope banks. This dedication shall take the form of an <br /> "Open Offer of Dedication". This area of land to be offered <br /> for dedication to the City shall be included in the adjacent <br /> open space parcel and shall remain a part of that parcel, <br /> landscaped and maintained by the project's homeowner's <br /> association, until such time that the City accepts such <br /> offer of dedication. <br /> <br />Page 6 <br /> <br /> <br />
