37. The applicant shall contribute the cost for the interim <br /> street improvements for the western half of Foothill Road as <br /> shown in the 1990 Foothill Road Alignment Study, across the <br /> full project frontage of the project site including the <br /> necessary transitions on both the north and south ends. <br /> Payment shall be due and payable prior to the recording of <br /> the first parcel map on this property. <br /> <br />38. The developer shall construct the private street across the <br /> northern property (Parcel A of PM 5423, currently owned by <br /> the applicant) to the terminus of the private street on the <br /> eastern property line of the Hempy property (PUD 88-16). In <br /> the event that the private street is not constructed across <br /> the Moller and Hempy properties prior to the approval of the <br /> minor subdivision for this project, the applicant shall <br /> negotiate in good faith with the property owners to acquire <br /> sufficient land to construct the access road from the <br /> project site to Foothill Road/Muirwood Drive North <br /> intersection, as shown on the development plan. Should the <br /> developer be unable to acquire said land, the development <br /> plan shall become null and-void. Evidence of the access <br /> easements for the entire private roadway and the <br /> establishment of the roadway maintenance agreement and <br /> entity shall be submitted for the review and approval by the <br /> City Attorney prior to the recordation of the parcel map. <br /> No final occupancy of the two new custom homes in this <br /> development shall be permitted until such time as the <br /> private street is constructed. <br /> <br />39. Access to Lot 3 shall be maintained at all times during <br /> construction. The applicant shall submit a plan to the City <br /> showing how access will be maintained during construction of <br /> the main road for City review and approval prior to the <br /> issuance of a grading permit. <br /> <br />'40. The deed restrictions for each lot shall indicate to <br /> potential buyers the responsibility of the owners for <br /> maintenance and repair of all roadways and private utility <br /> and service systems. <br /> <br />41. The final design and details of all on-site project <br /> utilities and off-site connections shall be submitted in <br /> conjunction with the minor subdivision. It is intended that <br /> all roadways and storm drains would be private and <br /> maintained by the homeowners' association, while the water <br /> and sanitary system would be public. It is intended that <br /> all utilities would be located within the roadway network <br /> whenever possible. The applicant shall grant a Public <br /> Service Easement over these roadways with public utilities. <br /> The applicant shall design the water system to ultimately be <br /> fed from the 770 zone water systems currently being planned. <br /> <br />Page 7 <br /> <br /> <br />
