the legal entity created for the maintenance and repair of <br /> the entire length of the private street. <br /> <br />28. The owner of the adjacent Starnes property shall be granted <br /> a 15' wide floating access easement over the Ku property <br /> site in order to provide access for maintenance purposes and <br /> livestock transportation to the rear portion of the Starnes <br /> parcel. This easement may not be used for purposes of <br /> livestock transportation more than six times (3 roundtrips) <br /> per year. This easement shall be shown on the final parcel <br /> map. The owner of the Starnes property shall also be given <br /> an access easement over the private road in order to gain <br /> access to the floating easement. <br /> <br />DESIGN GUIDELINES <br /> <br />29. Prior to the recordation of the parcel map for this <br /> property, all modifications and/or changes required by the <br /> Design Review Board, Planning Commission, and/or City <br /> Council to the Ku Property Design Guidelines shall be <br /> combined into a single comprehensive document. This <br /> document shall be submitted to the Planning Director for <br /> review and approval prior to its publication. The applicant <br /> or her successors in interest shall disclose the design <br /> guidelines to lot buyers prior to the close of escrow, and <br /> shall provide them with copies of the guidelines. <br /> <br />EMERGENCY VEHICLE ACCESS <br /> <br />30. The finaldesign and detail of the gate for the emergency <br /> vehicle access to be located adjacent to Foothill Road shall <br /> be submitted for the review and approval by the Planning <br /> Director and Fire Marshall prior to the recordation of the <br /> Parcel Map. Access from this road onto Foothill Road shall <br /> only be provided for emergency vehicles and a restriction <br /> stating this restricted access onto Foothill Road shall be <br /> recorded with the deed for the property prior to the <br /> recordation of the Parcel Map. The applicant shall install <br /> a knox box/lock, or other mechanism to enable City access, <br /> on the gate as required by the Fire Marshall. <br /> <br />PRIVATE DRIVEWAY TO EXISTING KU RESIDENCE ~ <br /> <br />31. The proposed 20' wide driveway to the Ku residence (Lot 3) <br /> shall be reduced in width to not exceed 16'. <br /> <br />UTILITIES AND PRIVATE STREET <br /> <br />32. The eastern edge of the 28' wide private street shall be a <br /> minimum 30' setback (the same roadway setback in the PUD-88- <br /> <br />Page 5 <br /> <br /> <br />
