Prior to the completion of the site grading, the applicant <br /> shall submit to the Planning Director, for review and <br /> approval, any anticipated deviations of the site grading <br /> from the approved grading plans. An "as-built" <br /> topographical survey, certified by a licensed surveyor, of <br /> the entire three-lot site shall be provided to the Planning <br /> Director prior to the approval of the custom home designs by <br /> the Design Review Board. <br /> <br />23. All areas depicted on the final grading plan as being "grade <br /> to daylight" shall be rounded and not left with any abrupt <br /> cut or fill. <br /> <br />24. A tree report by a certified arborist for the oak tree on <br /> the adjacent Starnee' property shall be required to be <br /> submitted to the Planning Director for review and approval <br /> prior to the submittal of the final grading plan. This tree <br /> report shall specify requirements necessary for the <br /> protection of this oak tree during the grading of the <br /> project site. The recommendations shall be included in the <br /> final grading plan. ~-' <br /> <br />RETAINING WALLS <br /> <br />25. All retaining walls shall be limited to five feet in height <br /> and shall be stepped, if feasible. If the total height of <br /> two adjacent retaining walls exceeds five feet, these walls <br /> must be separated by a minimum of ten linear feet. <br /> <br />26. All retaining walls visible from Foothill Road shall be <br /> faced with natural materials, such as natural stone, wood, <br /> etc. <br /> <br />DRIVEWAY EASEMENTS FOR STARNES PROPERTY <br /> <br />27. A 20' wide access easement for the benefit of the adjacent <br /> property to the south (Starnee property) shall be shown on <br /> the Minor Subdivision Plan. This driveway easement shall be <br /> located generally in the southeast portion of the Ku <br /> property. Prior to the Starnee property taking access to <br /> the private roadway or directly onto Foothill Road, the City <br /> must review and approve this access and the design of the <br /> driveway leading to the private road or Foothill Road. This <br /> ingress/egress easement, in addition to the use of private <br /> roadway, shall be recorded for the benefit of the property <br /> immediately to the south (Starnee). In the event that the <br /> owner of the Starnee property chooses to connect to the <br /> private road, the owner would be responsible for the <br /> construction of the driveway on this easement. At the time <br /> of connection to this private street, the owner of the <br /> Starnee parcel would be required to join and participate in <br /> <br />Page 4 <br /> <br /> <br />
