6. The developer stall establish a maintenance agreement with <br /> applicable CC&R's-for the project. The agreement shall <br /> designate responsibilities for maintaining all common private <br /> utilities, private streets, and landscape area between the <br /> frontage road and Foothill Road. The City shall be granted the <br /> rights and remedies through the agreement, but not the <br /> onilga~ion, to enforce the maintenance obligations. The City <br /> Attorney shall review and approve the proposed maintenance <br /> agreement prior to the recordation of a parcel map for the <br /> project. <br /> <br />7. Property owners to the south shall be granted access rights over <br /> the frontage road should they wish to eliminate their current <br /> access to Foothill Road and connect to the frontage road. This <br /> condition shall be reflected on the Parcel Map. <br /> <br />8. Property owners to the west who currently have access rights <br /> over the private road shall be granted additional access rights <br /> should they wish to develop in the future. The applicant shall <br /> be eligible for reimbursement of the access road construction <br /> costs. Those new property owners shall be required to join into <br /> the maintenance agreement to pay their pro-rata share of road <br /> and landscape maintenance expenses. <br /> <br /> 9. Development shall follow the conclusions and recommendations <br /> contained in the Geetechnical Engineering Investigation for Lamb <br /> Land Surveying, dated November 20, 1989, prepared by TetraSearch <br /> Inc. <br /> <br /> 10. The property is hereby rezoned to the PUD-LDR zoning <br /> designation. <br /> <br /> 11. Prior to Parcel Map approval, a bond for the private <br /> improvements including but not limited to streets, water, sewer, <br /> and storm drains shall be submitted to the satisfaction of the <br /> City Engineer. These improvements shall be constructed within <br /> one year of the recording of the Parcel Map unless otherwise <br /> approved by the Planning Director or City Engineer. <br /> <br /> 12. The alignment, width and grade of the private street shall be <br /> suD]ect to the approval of the City Engineer and Fire Marshall. <br /> The final street configuration shall be worked out prior to <br /> submittal of the parcel map. <br /> <br /> 13. The applicant shall extend underground public utilities <br /> (sanitary sewer, water, gas, electrical, telephones, cable T.V.) <br /> in the private street from Foothill Road in such a manner that <br /> when the frontage road to Jorgensen Lane is created, those <br /> existing utilities stubbed into the development from Foothill <br /> Road can be abandoned.' The developer shall grant the City a <br /> Dub!ic service easement ever said =-~ts. The !~c~ticn cf <br /> these shall be shown on the tentative map. <br /> <br /> <br />
