A minimum of 3 apartment units in the 20-unit apartment <br /> development shall be reserved for rental by "very low <br /> income" seniors. The remaining 17 units shall be reserved <br /> for "lower-income seniors". In addition to the 3 units <br /> noted above, the developer shall work with staff to seek <br /> optimal financing assistance for the project to ensure that <br /> the maximum number of units that is economically feasible <br /> are rented to "very low income" seniors. A "senior" shall <br /> be any individual 62 years of age or greater. "Lower <br /> income" and "very low income" shall mean =hose individuals <br /> or households whose incomes are no greater than 80% ("lower <br /> income") or 50% ("very low income") of the median household <br /> income for the Oakland Primary Metropolitan Statistical Area <br /> (PMSA) based on family size as established by the Department <br /> of Housing and Urban Development (HUD). The monthly rent <br /> for each of the affordable units shall not exceed <br /> one-twelfth of 30% multiplied by 80% (for lower-income) or <br /> 50% (for very low income) of the median income level for the <br /> Oakland PMSA as reasonably determined by the Planning <br /> Director on an annual basis for a household .of one or two <br /> persons (as applicable for each unit). These restrictions <br /> shall run wi~h the land and shall be formalized through a <br /> deed restriction recorded against the property. The details <br /> of said restrictions shall be subject to review and approval <br /> by the City Attorney and Planning Director prior to the <br /> issuance of building permits for the project and shall be in <br /> place prior to occupancy of any units. <br /> <br />7. The developer shall give rent preference in the new complex <br /> to any qualified tenants of the existing rental units on the <br /> subject property, to Pleasanton residents, and then, to <br /> Valley residents. In'addition, the developer shall use his <br /> best efforts to provide assistance to o~her tenants who are <br /> displaced ~hrough construction of the new senior apartments. <br /> A program for tenant assistance shall, at minimum, meet the <br /> standards in the City's condominium conversion ordinance and <br /> shall be submitted for review and approval by the Planning <br /> Director prior to the issuance of building permits for the <br /> project. <br /> <br />S. The applicant shall submit a lighting plan for the parking <br /> area for review and approval by the Planning Director prior <br /> to the issuance of building permits for the project. The <br /> lighting plan shall be designed to minimize the visual <br /> impact of the parking lot in the contex~c of the surrounding <br /> neighborhood and to minimize the intrusion of light into <br /> surrounding properties. <br /> <br /> <br />
