9. The applicant shall submit a current title report to the <br /> City Engineer prior to the issuance of any building permits <br /> for this project. <br /> <br /> 10. There shall be a concrete curb along the east property line <br /> adjacent to the parking lot. <br /> <br /> 11. The applicant shall pay his pro-rata share of the cost of <br /> undergrounding the existing overhead utility lines across <br /> the project frontages (St. Mary Street and Division Street). <br /> as determined by the City Engineer. Pa~nnent shall be due <br /> prior to the issuance of build~lg permits for this project. <br /> <br />12. The applicant shall reimburse the City for the cost of <br /> installing a sanitary sewer lateral for this project. <br /> Payment shall be due prior to the issuance of building <br /> permits for this project. <br /> <br />13. The applicant shall dedicate to the City a 5 foot wide strip <br /> of land (existing sidewalk) and an S foot wide public <br /> service easement (PSE) across the Division Street frontage <br /> of the site. <br /> <br />14. The developer acknowledges that this approval does not <br /> guarantee the availability of sufficient water to serve the <br /> project. The City shall withhold building permits for the <br /> project if, at the time building permits are applied for, <br /> mandatory water rationing is in effect, unless the City has <br /> adopted a water offset program and unless the developer is <br /> participating in the program. Notwithstanding the <br /> developer's participation in such a program, the City may <br /> withhold. building permits if the City determines that <br /> sufficient water is not available at the time building <br /> permits for the project are applied for. <br /> <br />15. That the final location of the garbage dumpster and <br /> enclosure shall be submitted for review and approval by the <br /> Planning Director prior to the issuance of building permits <br /> for the project. No garbage pick-up shall occur before <br /> S:00 a.m. daily. The garbage area shall be maintained at <br /> all times to avoid adverse impacts (i.e. odor, loose refuse, <br /> etc.) on neighboring properties. <br /> <br />16. The developer shall obtain all building and other applicable <br /> City permits for the project prior to the commencement of <br /> construction. <br /> <br />17. This project shall be subject to the Standard Conditions of <br /> Development, attached hereto and made part of this case by <br /> reference, except Conditions 7 and 25. <br /> <br /> <br />
