9. The applicant shall submit a current title report to the City Engineer prior to the issuance of any building permits for this project. 10. There shall be a concrete curb along the east property line adjacent to the parking lot. 11. The applicant shall pay his pro-rata share of the cost of undergrounding the existing overhead utility lines across the project frontages (St. Mary Street and Division Street). as determined by the City Engineer. Pa~nnent shall be due prior to the issuance of build~lg permits for this project. 12. The applicant shall reimburse the City for the cost of installing a sanitary sewer lateral for this project. Payment shall be due prior to the issuance of building permits for this project. 13. The applicant shall dedicate to the City a 5 foot wide strip of land (existing sidewalk) and an S foot wide public service easement (PSE) across the Division Street frontage of the site. 14. The developer acknowledges that this approval does not guarantee the availability of sufficient water to serve the project. The City shall withhold building permits for the project if, at the time building permits are applied for, mandatory water rationing is in effect, unless the City has adopted a water offset program and unless the developer is participating in the program. Notwithstanding the developer's participation in such a program, the City may withhold. building permits if the City determines that sufficient water is not available at the time building permits for the project are applied for. 15. That the final location of the garbage dumpster and enclosure shall be submitted for review and approval by the Planning Director prior to the issuance of building permits for the project. No garbage pick-up shall occur before S:00 a.m. daily. The garbage area shall be maintained at all times to avoid adverse impacts (i.e. odor, loose refuse, etc.) on neighboring properties. 16. The developer shall obtain all building and other applicable City permits for the project prior to the commencement of construction. 17. This project shall be subject to the Standard Conditions of Development, attached hereto and made part of this case by reference, except Conditions 7 and 25.
