need for expanded school facilities to serve new development <br /> in Pleasanton. The method and manner for the provision of <br /> these funds and/or facilities shall be subject to approval of <br /> the City and shall be in place prior to approval of the final <br /> map. In no event shall construction commence unless the above <br /> method and manner for the provision of these funds and/or <br /> facilities has been approved. <br /> <br />40. The applicant shall record CC&R~s at the time of recordation <br /> of the final map which shall create a homeowners association <br /> for the development. The CC&R~s shall be subject to the <br /> review and approval of the Cit3/Attorney prior to recordation <br /> of the final map. The homeowners association shall be <br /> responsible for the maintenance of all of the project <br /> soundwalls and the landscaped areas along the proj act ' s <br /> Stanley Boulevard frontage, in the proposed park area, and the <br /> areas located between the interior streets and the U.P.R.R. <br /> soundwall The City shall be granted the rights and remedies <br /> of the association, but not the obligation, to enforce the <br /> maintenance responsibilities of the homeowners association. The <br /> developer shall establish a landscape maintenance district for <br /> the maintenance of This district shall include all the <br /> owners of the lots in this development and the <br /> <br />41. The applicant shall implement the noise mitigation measures <br /> identified in ~he noise report-titled "Results of Preliminary <br /> Environmental Noise Analysis", dated November 27, 1991 and the <br /> addendum to this study, dated March 3, 1992 on file with~ the <br /> Planning Department. The applicant may submit a phasing plan <br /> for this development at the time of the tentative map which <br /> would allow the installation of an S~ high soundwall along <br /> S~anley Boulevard if it can be demonstrated that the height' of <br /> the soundwall would provide adequate noise a~enua=ion ~o 60 <br /> Ldn or-less for the rear' outdoor yard areas of the homes <br /> ~oughout the different phases. All soundwalls and homes <br /> must be designed to mitigate noise to 60 Ldn or less in the <br /> rear 3lard area atI the time of issuance of the building permits <br /> for-the respec~cive homes. <br /> <br />42. The applicant: shall replace the existing westerly property <br />wall along the Country Roads development with a new masonry <br />wall similar in design to the existing wall. The final design <br />and height of this wall shall be worked out with the adjacent <br /> residents in the CounL-7 Road development. The final <br /> configuration shall be submitted for review and approval with <br /> the ~enta=ive map. <br /> <br />43.
