bridge improvements on Bernal Avenue between Tawny Drive and <br /> Del Valle Parkway. The pro-rata cost shall be deemed <br /> satisfied with payment of a citywide traffic impact fee <br /> should such a fee be adopted prior to recordation of the <br /> first final map for the project and if said fee includes the <br /> aforementioned improvements. <br /> <br />16. The developer shall pay its pro-rata share toward the <br /> construction of any improvements for which a reimbursement <br /> agreement has been entered into between the City and another <br /> developer which includes this property as a benefitring <br /> property. Said agreements shall include, but are not <br /> limited to, the Bonds II reservoir reimbursement agreement <br /> and the Bernal Avenue reimbursement agreement (for the <br /> extension of Bernal Avenue through the Stanley Business <br /> Park). Payment shall be made in accordance with the terms <br /> of said agreements as long as said agreements are in full <br /> force and effect. <br /> <br />17. The developer shall work with the Pleasanton Unified School <br /> District and the City Planning Director to develop a <br /> program, in addition to the school impact fees required by <br /> State law and local ordinance, to offset this project's <br /> long-term effect on school facility needs in Pleasanton. <br /> This program shall be designed to fund school facilities <br /> necessary to offset this project's reasonably related effect <br /> on the long-term need for expanded school facilities to <br /> serve new development in Pleasanton. The method and manner <br /> for the provision of these funds and/or facilities shall be <br /> in place prior to approval by the City of the first final <br /> map for the residential portion of the project. In no event <br /> shall construction commence unless the above method and <br /> manner for the provision of these funds and/or facilities <br /> has been approved by the City. <br /> <br />18. The developer shall provide funding for the acquisition of <br /> 1) an off-road, 4-wheel drive vehicle and an off-road <br /> motorcycle for the Police Department, and 2) a 4-wheel drive <br /> grass rig and one-half (½) the cost of a water tender for <br /> the Fire Department. The developer will be eligible for <br /> reimbursement to the extent of his pro-rata share of the <br /> costs of these vehicles through the establishment by the <br /> City of a reimbursement agreement to include other hillside <br /> properties in the east hills, Vineyard Avenue corridor, and <br /> south Foothill Road areas of the City. The cost of said <br /> vehicles shall be determined by the City Engineer at the <br /> tentative map stage, and the fee shall be paid by the <br /> developer prior to approval of the first final map for the <br /> development. <br /> <br /> 5 <br /> <br /> <br />
