golf course operation, including but not limited to hours of' <br /> operation, public use provisions, membership, facilities, <br /> water, maintenance, lighting, rescue/emergency access, <br /> circulation, and traffic. If deemed necessary by the City <br /> Traffic Engineer, an updated traffic analysis shall be <br /> submitted to ensure that use of club house and practice <br /> range facilities, as proposed to be operated, will not <br /> result in an increase in the off-site traffic beyond that <br /> projected in the EIR. <br /> <br /> 11. The developer shall provide owners and prospective buyers of <br /> all residential lots with copies of the conditions of <br /> approval (PUD and tentative map) for the development. <br /> <br /> 12. If the residential development is to have a homeowners <br /> association, the developer shall record CC&R's at the time <br /> of recordation of the final map(s) for the residential <br /> portion of the project which shall create the association. <br /> The CC&R's shall be subject to the review and approval of <br /> the City Attorney prior to recordation of the first final <br /> map. The homeowners association shall be responsible for <br /> the maintenance of any private'streets, private utilities, <br /> and other common areas and facilities on the site, including <br />.. all landscaping and soundwalls extending to the face of <br /> curb. The City shall be granted the rights and. remedies of <br /> the association, but not.the obligation, to enforce the <br /> maintenance responsibilities of the homeowners association. <br /> <br /> 13. The owners and prospective buyers of all residential lots <br /> located adjacent to public open space areas shall be <br /> notified that the lots may receive overland runoff from the <br /> open space areas and that this may require integration with <br /> the individual drainage system on each lot. Specific <br /> reference to this requirement shall be incorporated into the <br /> deed for each lot. <br /> <br /> 14. The owners and prospective buyers of all residential lots <br /> shall be given a sales disclosure statement that Sections <br /> 31102, 31103, and 31104 of the California Agricultural Code <br /> empower a rancher to shoot domestic animals that are <br /> chasing, wounding or worrying livestock. The statement <br /> shall note that dog owners shall assume property damage cost <br /> when responsibility for maiming or destroying livestock is <br /> established. <br /> <br /> Fees and Bxactions <br /> <br /> 15. The developer shall pay its pro-rata share of planned street <br /> improvements to Bernal Avenue, to include a traffic signal <br /> at the intersection of Bernal Avenue and Vineyard Avenue <br /> (north), a traffic signal at the intersection of Bernal <br /> Avenue at Independence Drive, planned street widening and <br /> <br /> 4 <br /> <br /> <br />
