30. As part of the disclosure statement for the development, all future homeowners shall be <br /> notified that the common open space areas are required to be owned and maintained, in <br /> perpetuity, by the homeowners association and that portions of these areas are to be <br /> accessible by the public, as described in Condition No. 29. This wording shall be <br /> submitted to the Planning Director and City Engineer for review and approval prior to <br /> final map approval. <br /> <br />31. The applicant shall comply with the recommendations of the geotechnical reports prepared <br /> by HARZA for the subject development on file with the Planning Department as reviewed <br /> and referenced by the City's geotechnical engineer in letters dated January 6, 1995 and <br /> January 11, 1995. The applicant's geotechnical consultant shall review and approve all <br /> foundation, retaining wall, and drainage geotechnical aspects of the final development <br /> plans to ensure that the recommendations have been properly incorporated into the <br /> development. The consultant shall certify by writing on the plans or as otherwise <br /> acceptable to the Director of Building Inspection that the final development plan is in <br /> conformance with the geotechnical report approved with the project. <br /> <br />32. The applicant shall arrange and pay for the geotechnical consultant to inspect and approve <br /> all foundation, retaining walls, and drainage geotechnical aspects of project construction. <br /> The consultant shall be present on site during mass grading and mass excavation <br /> operations. The results of the inspections and the as-built conditions of the project shall <br /> be certified in writing by the geotechnical consultant for conformance to the approved <br /> plans and geotechnical report and submitted to the City Engineer and Director of Building <br /> Inspection for review and approval prior to occupancy. <br /> <br /> 33. Prior to issuance of a grading permit, a temporary four (4) foot high fence (such as a <br /> plastic snow fence) shall be placed at a minimum distance often (10) feet from the top of <br /> the creek bank, as shown in the report entitled "Outstanding Geotechnical Issues" <br /> prepared by HAKZA, dated December 20, ~ 1994. At no time shall grading take place <br /> within this area, other than grading necessary to prevent drainage from flowing overland <br /> into the creek. <br /> <br /> 34. Prior to grading operations commencing within 20 feet of the creek bank, the geotechnical <br /> consultant shall review the grading operations to ensure that the cut-slope will be stable, <br /> or that additional methods of stabilization will be implemented to prevent any impact to <br /> the creek bank. Any methods not specifically part of the geotechnical report shall first <br /> receive approval by the City Engineer and Planning Director before they are implemented. <br /> <br /> PUD-94-04 - City Council Conditions Of Approval - Page <br /> <br /> <br />
