88. Extension of Pleasanton Avenue on the project shall align with existing Pleasanton Avenue <br /> to the satisfaction of the City Engineer. The City Engineer shall work with the developer <br /> in determining the final alignment of this intersection. Should modifications be required to <br /> the curb lines, the developer is allowed to adjust adjacent yard setbacks, lot sizes, and <br /> property lines. This information shall be submitted in conjunction with the tentative map. <br /> <br />89. Developer shall acquire necessary right-of-way and easements to allow for a 20 foot <br /> radius right-of-way return for the southwest corner at Pleasanton Avenue and St. lohn <br /> Circle. <br /> <br />90. Minimum face of curb radius at the returns shall be 30 feet. <br /> <br />91. Existing St. John Street shall be reconstructed to the centerline across the project frontage <br /> to the satisfaction of the City Engineer. The developer shall repair any major damage to <br /> Pleasanton Avenue prior to acceptance of the final improvements. The developer shall not <br /> be required to overlay the entirety of Pleasanton Avenue. <br /> <br />92. The Arroyo Del Valle and private park shall be owned and maintained as one parcel by the <br /> homeowners association. <br /> <br /> 93. In the event that additional work is required due to the construction of the project within <br /> the banks of the Arroyo Del Valle beyond that which was anticipated by the geotechnical <br /> reports and PUD development plan, a detail description of this work shall be submitted to <br /> the City Engineer and Planning Director for review prior to any such activities. The City <br /> Engineer and Planning Director shall determine whether said work is consistent with the <br /> scope of work identified in the geotechnical reports and PUD development plan. If the <br /> work is not consistent, additional review, which may include a PUD modification and <br /> environmental review, may be required. <br /> <br /> 94. The developer shall conduct the first year maintenance activities, in accordance with the <br /> approved Arroyo Del Valle maintenance plan. In addition, the developer shall to the best <br /> of their ability obtain a long-term permit from the Department of Fish & Game to allow <br /> the eventual maintenance of the creek area by the homeowners association. The developer <br /> shall continue the yearly maintenance activities until the homeowners association's <br /> responsibilities are completely assumed by the future private homeowners. <br /> <br /> 95. Developer shall obtain all necessary permits for work within the Arroyo Del Valle from <br /> the Army Corps of Engineers and Department of Fish and Game. <br /> <br /> 96.
