97. The homeowners association, or developer, shall provide to the City Engineer an annual <br /> report detailing the condition, required maintenance, and slope repairs for the homeowner <br /> association's property within the Arroyo Del Valle. The City Engineer may require that <br /> portions of the report by prepared by a registered civil engineer to address identified <br /> engineering concerns. <br /> <br />98. All existing overhead lines within the subdivision shall be removed or installed <br /> underground. The developer shall consolidate and eliminate, where practical, those <br /> overhead lines which currently cross the arroyo to the best of his ability. In those cases <br /> where it is not practical for the line(s) and pole(s) along the creek to be removed, power <br /> shall be supplied through the mini-park along the top of the bank and no anchors or guide <br /> poles shall be installed in the individual residential lots. <br /> <br />99. Building foundation shall be setback from the toe of the Arroyo Del Valle a minimum <br /> distance to provide a 2 to 1 slope bank plus 20 feet unless foundations are designed to <br /> accommodate a lesser setback recommended by the soils engineer and approved by the <br /> Director of Building and the City Engineer. <br /> <br /> 100. Construction debris and unsuitable materials shall be removed as required by the project <br /> soils engineer. This work shall not extend beyond the existing top of bank. <br /> <br /> 101. Prior to commencement of any clearing, grading, or excavation, the applicant shall submit <br /> to the Planning Department a copy of the State Water Kesources Control Board Notice of <br /> Intent ('NOI) for coverage under the State Construction Storm Water General Permit. <br /> <br /> 102. The applicant shall submit a construction Best Management Practice (BMP) program for <br /> review and approval by the Planning Director prior to issuance of any building and/or <br /> grading permits. These BMP's shall be implemented by the general contractor and all <br /> subcontractors and suppliers of materials and equipment. Construction site cleanup and <br /> control of construction debris shall also be addressed in this program. Failure to comply <br /> with the approved construction BMP may result in the issuance of correction notices, <br /> citations, or a project stop work order. <br /> <br /> 103. The applicant is responsible for implementing the following measures during all <br /> construction phases of the subject project: <br /> <br /> a.) Gather all construction debris on a regular basis and place them in a dumpster or other <br /> container which is emptied or removed on a weekly basis. When appropriate, use tarps on <br /> the ground to collect fallen debris or splatters that could contribute to storm water <br /> pollution. <br /> <br /> b.) Remove all dirt, gravel, rubbish, refuse, and green waste from the street pavement, <br /> and storm drains adjoining the project site.
