The Pleasanton Sewerage <br />Code may provide for monitoring of Capacity discharges by <br />Developer and Assignees into the City wastewater system <br />(sewers). If, in violation of the Pleasanton Sewerage Code, <br />Developer or an Assignee discharges an amount in excess of the <br />amount allocated by City to Developer or Assignee for a <br />particular premises, City shall have all enforcement rights set <br />forth in the Pleasanton Sewerage Code, but City shall not have <br />the right to reduce the Capacity by the amount of such excess. <br /> <br /> Section 2.02. Reservation of Capacity. <br /> <br /> (a) Sufficient of Capacity. To assure that <br />sufficient Treatment Capacity will be available to permit <br />Developer's and Assignee's use of the Capacity through the Term <br />of the Amendment, City shall at all times reserve for <br />allocation to Developer and Assignees Treatment Capacity in an <br />amount at least as great as: <br /> <br /> (1) the Original Capacity; <br /> <br />and then, as the Original Capacity is reduced (pursuant to <br />Section 2.02(b) of this Exhibit B), <br /> <br /> (2) the Remaining Capacity~ <br /> <br />and then if the Remaining Capacity is increased (pursuant to <br />Section 2.02(c) of this Exhibit B), <br /> <br /> (3) the Increased Remaining Capacity. <br /> <br /> 5 <br />7.0/0597F. 007/051093/14123-006 <br /> <br /> <br />
