"Reacquire" shall have that meaning set forth in <br />Section 3.01(b) of this Exhibit B. <br /> <br /> "Remaining Capacity" shall have that meaning set forth <br />in the definition of "Original Capacity." <br /> <br /> "Residential Discharge Equivalent" or "RDE" shall mean <br />a sewage discharge equal in volume and strength to the <br />discharge from the typical single family dwelling, as <br />determined pursuant to the Pleasanton Sewerage Code (under the <br />current Pleasanton Sewerage Code, approximately 220 gallons of <br />Capacity is equivalent to 1RDE of Capacity). <br /> <br /> "Treatment Capacity" shall mean wastewater (sewage) <br />collection, transmission, treatment and disposal capacity. <br /> <br /> "Unaffiliated Assignee" shall mean (1) an Assignee not <br />directly or indirectly controlling, controlled by, or under <br />common control with, Developer~ (2) an Assignee of which <br />Developer does not own or control ten percent (10%) or more of <br />the outstanding voting securities; and (3) an Assignee which is <br />not an officer, director or partner of Developer. <br /> <br />ARTICLE 2. RESERVATION/ALLOCATION <br /> <br /> Section 2.01. Capacity Subject to Code. <br /> <br /> (a) Pleasanton Seweraqe Code. The Capacity, <br />whether used by Developer or an Assignee, shall be generally <br />subject to the terms of the Pleasanton Sewerage Code.
