(b) Reduction of Capacity. The Capacity shall <br />be reduced by City only by the amount of Treatment Capacity <br />which: <br /> <br /> (1) is allocated to Developer by City for <br />use by Developer on the Property; and <br /> <br /> (2) is both assigned by Developer to an <br />Assignee pursuant to an Assignment of Capacity and is allocated <br />to such Assignee by City (in accordance with Article 3 of this <br />Exhibit B) for use by Assignees on the Property. <br /> <br /> (c) Reevaluation. City shall monitor the <br />Capacity throughout the term of the Amendment as follows: <br /> <br /> (1) Coefficients Chanqe. Should the <br />applicable Coefficients be revised or modified in a manner that <br />results in the need for more Capacity than that already <br />reserved by the City (pursuant to the Amendment and this <br />Exhibit B), then the City shall immediately reserve such <br />additional Treatment Capacity as is necessary to allow the <br />buildout of the Property under such revised or modified <br />Coefficients (the "Increased Remaining Capacity"). The <br />Coefficients under which the Original Capacity was determined <br />are those that were in place at the time the Amendment was <br />adopted by the City. <br /> <br /> (2) 75% Use. In addition to the <br />requirements of Section 2.02(c)(1) above, at such time as the <br />Original Capacity has been reduced by 75% by City pursuant to <br />Section 2.02(b) of this Exhibit B (so that the Remaining <br />Capacity is 25% of the Original Capacity), City and Developer <br />shall determine the Treatment Capacity that will be needed to <br />complete the buildout of the Property (for the purposes of this <br /> <br /> 6 <br />7.0/0597 F. 007/051093/14123-006 <br /> <br /> <br />
