Ordinance No. 1584 <br />Page Five <br /> <br /> A. A finding as to whether the applicant has ever been <br /> convicted of a felony or the violation of any narcotic <br /> law or of any penal law involving moral turpitude, theft, <br /> or fraud; and <br /> <br /> B. A finding as to whether the applicant has ever had the <br /> proprietary use, ownership or control of any Taxicab in <br /> any other City within the state, and what, if any, <br /> records exist concerning the prior operation and <br /> management of such Taxicab service. <br /> <br /> 6.40.040 City Council Hearinq. <br /> <br /> Upon the filing of the fully completed application for the <br /> Certificate, together with the report and findings of the <br /> Police Chief, the City Council shall fix a time and place for <br /> a public hearing thereon. At least five days written notice <br /> of the time and place set for the public hearing shall be <br /> given to the applicant and to all persons holding valid <br /> Certificates. Notice of the time and place of the public <br /> hearing before the City Council shall be published once in a <br /> newspaper of general circulation in the City at least ten days <br /> before the hearing. <br /> <br /> 6.40.050 Certificate-Issuance- <br /> <br /> If the City Council finds that further Taxicab service in the <br /> City is required by the public convenience and necessity and <br /> that the applicant is fit, willing, and able to performto the <br /> provisions of this chapter and any and all rules promulgated <br /> by the Police Chief, then the City Council shall by resolution <br /> declare that the public convenience and necessity require <br /> additional Taxicab service, and that a Certificate be issued <br /> by the Police Chief. The Certificate shall state the name and <br /> address of the applicant, the number of vehicles authorized <br /> under said Certificate, the location of a Closed Stand for the <br /> applicant's use, and the date of issuance. If the City <br /> Council cannot make these findings, the application shall be <br /> denied. In making the findings provided in this section, the <br /> city council shall take into consideration the following: <br /> <br /> A. The number of Taxicabs already in operation; <br /> <br /> B. Whether existing transportation is adequate to meet the <br /> public need; <br /> <br /> C. The probable effect of increased service on local traffic <br /> conditions; <br /> <br /> D. The character, experience and responsibility of the <br /> applicant; <br /> <br /> <br />
