applied for, mandatory water rationing is in effect, unless the City has adopted a water off- <br /> set program and unless the developer is participating in the program. Notwithstanding the <br /> developer's participation in such a program, the City may withhold building permits if the <br /> City determines that sufficient water is not available at the time of application of building <br /> permits. <br /> <br />14. The developer shall provide a bond to the City guaranteeing the installation of all common <br /> open space and recreational improvements, private streets, street trees, and all common in- <br /> frastructure improvements shown on the approved development plan or otherwise re- <br /> quired as part of this development. The applicant shall provide an itemized cost estimate <br /> of said improvements, to be submitted with the bond, for the review and approval the <br /> Planning Director prior to issuance of building permits. The bond shall be returned to the <br /> applicant upon acceptance of said improvements by the Planning Director. <br /> <br />15. The developer shall disclose the following items to prospective purchasers of this develop- <br /> ment: <br /> <br /> a. The location of the Livermore Airport, aircraft operational levels, and projected <br /> noise levels. <br /> <br /> b. The planned extension of Stoneridge Drive across the Arroyo Mocho to E1 Charro <br /> Road. <br /> <br /> c. The probable future use of the Kaiser Sand and Gravel quarry as a regional recrea- <br /> tion area similar to Shadowcliffs, that the existing berm/mound separating the project <br /> site from the quarry may be removed, and that a pedestrian/bicycle/equestrian trail <br /> may be installed in the area located between this site and the quarry property. <br /> <br /> The disclosure shall be submitted to the City Attomey for review and approval before is- <br /> suance of building permits. <br /> <br /> 16. The applicant shall record CC&R's at the time ofrecordation of the final map which shall <br /> create a property owners association for the development. The CC&R's shall be subject to <br /> the review and approval of the City Attorney prior to recordation of the final map. The <br /> CC&R'S shall include the following items: <br /> <br /> a. The property owners association shall be responsible for maintenance of all private <br /> streets, private utilities, and other common areas and facilities on the site, including <br /> all landscaping, soundwalls extending to the face of curb, and back-up landscaping <br /> between the soundwall and face of curb on Stoneridge Drive and Dennis Drive. <br /> <br /> PUD-91-11-1M January 21, 1997 <br /> Conditions of Approval Page 3 <br /> <br /> <br />
