1. Availability of Building Permits to First-Come, First-Served <br /> Projects. <br /> <br /> a. Initial Sub-Allocation and Adjustments <br /> The first-come, first-served project sub-allocation shall be as <br /> initially established in subsection 17.36,070(B)(2) and may be <br /> modified from time to time by the City Council as described in <br /> section 17.36,070. <br /> <br /> b. Set-Aside for Small Projects <br /> Of the total first-come, first-served sub-allocation, fifteen (15) units <br /> shall be set aside and shall be available only to building permit <br /> applications for custom residential units on existing lots of record at <br /> least one year old on the date of building permit issuance or for <br /> units within a project of four or fewer units. Five units shall <br /> become available on a first-come, first-served basis on the first <br /> working day following March 31, June 30, and September 30, <br /> respectively. Unused units from any period shall be added to the <br /> following period. If unused as of December 1, these shall become <br /> available to any developer of a first-come, first-served project or a <br /> major project developer. <br /> <br /> c. Unused Major Project Sub-Allocation <br /> In the event that major project developers, in the aggregate, do not <br /> seek to utilize all the units included in an annual sub-allocation for <br /> major projects, any unused sub-allocation following the annual <br /> review in September shall be added to the units available for <br /> first-come, first-served projects. <br /> <br /> d. Unused Fifteen Unit Set-Aside <br /> In the event that any of the fifteen units set aside pursuant to <br /> subsection 17.36.080(C)(1)(b) are not used as of December 1, <br /> these shall be added to the units remaining available in the <br /> first-come, first-served sub-allocation. <br /> <br />2. Approval Process. <br /> <br /> a. Prerequisites for Issuance of Building Permit <br /> <br /> A project developer may obtain first-come, first-served building <br /> permits when, following the normal course of processing an <br /> application, the application is deemed eligible for issuance of a <br /> permit by the Building Division and the sub-allocation for <br /> first-come, first-served projects has not been fully utilized. Building <br /> permits will be issued typically following a project's first having <br /> <br /> 11 <br /> <br /> <br />
