Either the area of the old fill shall be <br /> removed and re-engineered to specifications approved by the City Engineer and the <br /> City's Reviewing Geologist, or all structures constructed on this fill shall be supported by <br /> piers penetrating below the colluvium layer to a level approved by the City Engineer and <br /> City's Reviewing Geologist. The developer shall be responsible for the cost of the review <br /> performed by the City's Reviewing Geologist in determining which alternative would be <br /> in the best interest of the public's health and safety. <br /> <br />7. No habitable structures shall be constructed within the area designated on 'the plan as the <br /> 50 ft. setback from the fault zone. <br /> <br />8. The 0.4 acre remainder parcel shown on the western side of the project site, located <br /> between Lot 1 and the existing Yee driveway, shall be granted to the Yees at the time of <br /> City Council approval of the final map. This change shall be shown on the tentative map <br /> and final maps. <br /> <br />9. A detail of the street lighting fixture shall be submitted for the review and approval by the <br /> Planning Director and City Engineer prior to the City Council approval of the final map... <br /> <br /> 10. A sample of the proposed retaining wall material shall be submitted for the review and <br /> approval of the Planning Director prior to the City Council approval of the final map. <br /> These walls shall be constructed utilizing a keystone retaining wall system with a <br /> sculpted rock texture block with an earthtone color. Calculations signed by a registered <br /> civil engineer shall accompany the wall plans. <br /> <br />11. A landscape plan for the slopebank area easterly and northerly of the private driveway in <br /> front of Lots 5 and 6 shall be submitted for the review and approval of the Planning <br /> Director prior to the approval of the tentative map. This landscaping shall encompass the <br /> area bounded by Equus Court to the south, the existing tree line along the creek to the <br /> north, the private driveway to Lot 6 and the Fuller property to the west, and the edge of <br /> Foothill Road to the east. This landscape plan shall consist of native and/or indigenous <br /> plant species in an informal design. This slopebank landscape area shall be maintained <br /> by the owner of Lot 6. The Foothill Road landscaping on the south side of the Equus <br /> Court shall be maintained by the owners on which the landscaping is located, Lots 3 and <br /> 4. Both this planting area and that shown along the project's Foothill Road frontage shall <br /> be planted by the developer as part of the project's subdivision improvements. A bond, <br /> cash, or other security acceptable to the City Attorney for these landscaping maintenance <br /> costs for three years shall be submitted to the City prior to the City Council approval of <br /> the final map and shall not be released until three years after the date the subdivision <br /> improvements are accepted by the City or these areas are turned over for maintenance by <br /> the homeowners living on the lots on which the landscaping is located.
