'Exhibit B <br /> Equus Heights/PUD-98-1 <br /> Caty Councti <br /> <br />Plannine <br /> <br />1. Development shall be substantially as shown on the development plan, landscape plan, <br /> Foothill Road improvement plan, design guidelines, and related materials, Exhibit "A", <br /> dated "Received" March 16, 1998, on file with the Planning Department, except as <br /> modified by the following conditions. Minor changes to the plans may be allowed <br /> subject to the approval of the Planning Director if found to be in substantial conformance <br /> to the approved exhibits. <br /> <br />2. The applicant shall obtain all building and other applicable City permits for the project <br /> prior to the commencement of construction. <br /> <br />3. The permitted and conditional uses of the property shall be those of the City's R-1 <br /> (Single-family Residential) zoning district. <br /> <br />4. Except as modified in the project's design guidelines, any future building additions, <br /> accessory structures, etc. proposed for the custom home lot shall adhere to the <br /> requirements of the R-I-40,000 zoning district. Any plans for these proposed structures <br /> shall be submitted for the review and approval by the Planning Director for determination <br /> that these proposed structures or changes are consistent with the West Foothill Road <br /> Corridor Overlay District ordinance and design guidelines. <br /> <br /> 5. This PUD development plan approval shall lapse and shall become void 2 years from the <br /> date of approval unless a final map has been approved and recorded for the modified <br /> configuration of these six lots. <br /> <br /> 6. The developer shall adhere to all of the recommendations of the Detailed Gcotcchnical <br /> Investigation on Equus Heights prepared by Tetrasearch, Inc., dated February 1990 and <br /> the Geotechnical Review prepared by William Cotton and Associates, dated September <br /> 1990, and all other pertinent geologic and gcotcchnical Studies prepared for this site on <br /> file with the Planning Department. In the event that no additional documentation, <br /> acceptable to the City Engineer and the City's Reviewing geologist, is provided by the <br /> applicant prior to the City Council approval of the final map certifying that the old fill in <br /> SR:98:89 <br /> Page 6 <br /> <br /> <br />
