The developer acknowledges that the City of Pleasanton does not guarantee the <br /> availability of sufficient sewer capacity to serve this development by the approval <br /> of this case, and that the developer agrees and acknowledges that building petwalt <br /> approval may be withheld if sewer capacity is fbund by the City not to be <br /> available. <br /> <br />59. The developer shall provide a bond to the City guaranteeing the installation of all <br /> common open space and recreational improve~nents, private streets, street trees, <br /> and all common infrastructure improvements shown oI1 the approved development <br /> plan or otherwise required as part of this development. The developer shall <br /> provide an itemized cost estimate of said improvements, to be submitted with the <br /> bond, for the review and approval the Planning Director prior to issuance of <br /> building permits. The bond shall be returned to the developer upon acceptance of <br /> said improvements by the Planning Director. <br /> <br />60. The applicant shall submit a refundable cash bond for hazard and erosion control <br /> prior to issuance of an Engineering or Building Department permit. The amount of <br /> this bond will be determined by the City Engineer. <br /> <br />6l. The applicant shall dedicate to the City for street right-of-Way purposes those <br /> parcels of land intended to be public streets. Additional right-of-way dedication <br /> than that shown on the site plan may be required to accommodate a meandc, ring <br /> sidewalk along the east side of Foothill Road. <br /> <br />62. The applicant shall grant an easement to the City over those parcels needed for <br /> public service easements (P.S.E.) and which are approved by the City Engineer or <br /> other easements which may be designated by the City Engineer. <br /> <br />63. The design for the line, grade, and structural sections for the streets serving this <br /> development shall be subject to final review and approval by the City Engineer. <br /> <br />64. The applicant shall construct vertical P.C.C. curbs and gutters within this <br /> development unless otherwise approved by the City Engineer. When the sidewalk <br /> is adjacent to the curb and gutter, they shall be poured monolithically. <br /> <br />65. All existing wells on the site shall be removed or sealed, filled and abandoned <br /> pursuant to Alameda County Ord. 73-68, prior to the start of grading operations <br /> unless Zone 7 retains specific wells for observation wells, or special approval is <br /> <br /> PUD-96-14 <br /> <br /> <br />
