A motion was made by Commissioner Kameny, seconded by Chairperson Roberts to grant the <br />appeal of the Zoning Administrator's denial of a conditional use permit to operate a large-family <br />dayeare facility for 12 children at an existing residence located at 4350 First Street. Further, that <br />Case AP-99-09 be approved by making the three required conditional use permit findings and <br />approving Case AP-99-09 subject to the modified conditions of approval listed in Exhibit "B." <br />Further, that the Traffic Committee examine issues relating to the curb in front of applicant's <br />property being designated as a loading zone; that this application be monitored until such time <br />that the First Street Bridge is opened up; and, that parents be notified that the number of children <br />could be reduced from 12 to 8 if unsafe traffic conditions are found to exist. <br /> <br />ROLL CALLVOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Kameny, Kumaran, Sullivan and Chairperson Roberts <br />Commissioner Maas <br />None <br />None <br /> <br />Resolution No. PC-99-94 was entered and adopted as motioned. <br /> <br />Commissioner Maas noted her no vote is due to her belief that First Street is not a safe place for <br />increasing traffic. Further, that by approving this appeal, a traffic hazard is being created and that the <br />inevitable is being postponed. <br /> <br />Commissioner Kumaran encouraged the applicant to have an internal condition to stagger drop-off and <br />pick-up times for new day-care children. <br /> <br />(Recess taken from 9:20 to 9:30 p.m.) <br /> <br />PUD-98-15, Mardel, LLC/Costas <br />Application for PUD development plan approval for a residential subdivision of an existing <br />4.7-acre site, including six building sites, a public equestrian/pedestrian trail, public streets, <br />and land area set aside for the future alignment of Vineyard Avenue. The property is <br />located at 2503 Vineyard Avenue between Vineyard Avenue and the Shadow Cliffs <br />Regional Recreation Area. Zoning for the property is PUD (Planned Unit Development) - <br />LDR (Low Density Residential District). The Planning Commissioner will also consider the <br />Negative Declaration prepared for thc application. <br /> <br />Mr. Plucker referenced a staff report dated November 10, 1999 and highlighted key areas contained in <br />the report including background information, project description, Vineyard Avenue Realignment, and <br />building design. In conclusion, he noted that staff's recommendation is that the Commission forward <br />Case PUD-98-15, development plan alternative two, to the City Council with a recommendation for <br />approval by making the finding that the proposed project would not have a significant impact on the <br />environment and adopt a resolution recommending approval of Exhibit "B," the draft Initial Study and <br />Negative Declaration; make the finding that the proposed PUD development plan is consistent with the <br />Pleasanton General Plan; make the PUD development plan findings stated in the staff report; and adopt a <br />resolution recommending approval of Case PUD-98-15 subject to the draft conditions of approval stated <br />in Exhibit "B." <br /> <br />PLANNING COMMISSION MINUTES Page 10 November 10, 1999 <br /> <br /> <br />
