AYES: Commissioners Kameny, Kumaran, Maas, Sullivan and Chairperson Roberts <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. PC-99-87 was entered and adopted as motioned. <br /> <br />(Commissioner Kameny leaves the meeting at 10:57 p.m.) <br /> <br />6. PUBLIC HEARINGS <br /> <br />PUD-85-11M/Z-99-235/UP-99-56, Gary Monzo <br />Application for (1) a modification to the approved development plan for PUD-85-15 <br />(Golden Eagle Farm) to allow an existing residence to encroach within the front and <br />northern side yard; (2) a modification to the approved development plan to further reduce <br />the northern side yard setback for a proposed addition; (3) design review of an <br />approximately 2,178 square foot first- and second-story addition to an existing residence; <br />and (4) a conditional use permit for an attached second unit located at 8023 Golden Eagle <br />Way. Zoning for the property is PUD (Planned Unit Development) - LDR (Low Density <br />Residential) District. <br /> <br />Mr. Plucker referenced a staff report dated October 27, 1999 and highlighted key areas contained in the <br />report including background information and site and project description. In conclusion, Mr. Plucker <br />noted that staff's recommendation is that the Commission approve Case Z-99-235 and UP-99-56 and <br />recommend approval of Case PUD-85-15-11M to the City Council by taking the following actions: find <br />that the PUD modification is consistent with the General Plan and purposes of the PUD ordinance; make <br />the PUD findings listed in the staff report; recommend approval of the PUD modification subject to the <br />_conditions of approval listed in Exhibit "B. 1" to the City Council; make the use permit findings listed in <br />the staff report; approve the use permit subject to the conditions of approval listed in Exhibit "B.2"; and <br />approve the design review application subject to the conditions of approval listed in Exhibit "B.3". <br /> <br />Discussion ensued relating to whether there are structures to the north of applicant's property, the side- <br />yard setbacks, and that the homeowner's association and surrounding neighbors have approved the <br />addition. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Gary Monzo, applicant, noted he has spoken to all neighbors and they are enthused with the plan and he <br />stated that the plan is consistent with the design guidelines. Further, he noted that the extended wall <br />moves closer to the property line and that the entire structure is not the encroachment. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />A motion was made by Commissioner Maas, seconded by Chairperson Roberts, to approve Case <br />Z-99-235 and UP-99-56 and recommend approval of Case PUD-85-15-11M to the City Council by <br />taking the following actions: Find that the PUD modification is consistent with the General Plan <br />and purposes of the PUD ordinance; make the PUD findings listed in thc staff report; recommend <br /> <br />PLANNING COMMISSION MINUTES 16 October 27, 1999 <br /> <br /> <br />
