Jack Keane, 417 Sycamore, noted the approval for landscaping was granted in 1997 and that the house is
approximately 3500 square feet, contrary to what was contained in the staff report. He commented on
the animosity that has developed on the part of Mr. Dingman toward the Keane family. He commented
on the compromises that he has made including relocating and reducing the size of a bedroom window,
and relocating and amending the size and types of trees. He noted that he has worked with the
neighbors to develop a feasible plan. In conclusion, he noted his willingness to compromise and accept
the Planning Director's recommendation, and he requested that the appeal be denied. He submitted a
memorandum to the Commission from John Severini.

Discussion ensued relating to Condition No. 7.

Earl Bach, 446 Sycamore Road, commented on the recent City Council meeting that Mr. Dingman
attended. He noted that the City staff has created a situation which could turn dangerous, in his opinion.
He commented on the behavior of the Dingmans. He commented on the beauty of the Keanes'
landscaping and noted that the landscaping is adequate at the present time; however, he stated that the
Keanes are willing to meet staff's recommendations.

Hoss Bozorgzad, 6546 Arlington Court, noted that the Keane's are reasonable and compromising people
who seek to keep the neighborhood and community as pleasant as possible. He requested that the
Commission support staff's recommendation.

PUBLIC HEARING WAS CLOSED

Commissioner Kameny noted it is unfortunate that the process has evolved to this point and he noted
that staff has made a recommendation to alleviate the problem by modifying the landscaping plan. He
commented on how unfortunate it is when there is discord among neighbors. He stated that if staff feels
that the modified plan will accomplish what the original plan should have done, he would be in support
of approving the modified plan and with denying the appeal for this application.

Chairperson Roberts commented on the recent City Council meeting that Mr. Dingman attended and she
noted she would be in favor of approving the modified plan.

Commissioner Maas stated that if the applicant agrees with the modified plan, the plan should be
approved.

Commissioner Kumaran empathized with the applicant and he noted that staff has attempted to resolve
all issues in the modified plan.

Commissioner Sullivan made a motion to uphold staff's approval of the Modified Plan by denying the
appeal. Commissioner Kameny seconded the motion.

A motion was made by Commissioner Sullivan, seconded by Commissioner Kameny, to uphold
staff's approval of the Modified Plan by denying the appeal.

ROLLCALLVOTE

PLANN1NG COMMISSION MINUTES 15 October 27, 1999
