In response to an inquiry by Commissioner Arkin relating to staff providing estimated timelines for <br />agendized items, Mr. Plucker noted that staff hesitates to establish timelines for items due to extended <br />public testimony and that the applicants and the public might judge their appearance based on staff's <br />time estimates. <br /> <br />5. MATTERS CONTINUED FOR DECISION <br /> <br />There were none. <br /> <br />6. PUBLIC HEARINGS <br /> <br />UP-99-66, Sylvan Learning Center <br />Application for a conditional use permit operate a supplementary educational instruction <br />facility for children and teens (grades one through twelve) within an existing tenant space <br />located at 3003-A Hopyard Road (Hopyard Village Shopping Center). Zoning for the <br />property is PUD-C-C (Planned Unit Development -Central Commercial) Residential) <br />District. <br /> <br />Mr. Plucker referenced a staff report dated October 13, 1999, and highlight key areas contained in the <br />report including background information, site and project description, land use, noise, and parking. In <br />conclusion, Mr. Plucker noted that staff's recommendation is that Commission make the conditional use <br />findings as listed in the staff report, and approve Case UP-98-66 subject to the conditions listed in <br />Exhibit "B". <br /> <br />Discussion ensued relating to the activity that a restaurant would generate, staff's determination of <br />whether there is adequate property for the zoning certificate, typographical error on page 4 of the staff <br />report, conditional use being on a first-come, first-serve basis, the number of parking spaces in the <br />shopping center, the location and the aesthetics of the proposed door on Hopyard Road. <br /> <br />The applicant noted that there is no instruction on Friday evenings after 5:00 p.m. In response to an <br />inquiry by Commissioner Maas relating to the emergency door facing Valley and Hopyard Road, the <br />applicant noted that after conversation with the architect that the door may not be required on this <br />property; however, if door is required it will be relocated around the side of the building due to lack of <br />clearance and conflict of location with the berm. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />There were no public speakers. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Maas moved that the Commission make the conditional use findings as listed in the staff <br />report and approve Case Up-98-66, subject to the conditions listed in Exhibit "B".
