FEIR reflects Pleasanton's independent judgment and analysis. Further, for the project as a whole, that <br />the Commission could either deny the project; or make the findings as outlined in the earlier reports that <br />the project, as approved, incorporates all feasible mitigation measures; has overriding considerations for <br />its approval notwithstanding the residual significant environmental effects; is consistent with the <br />General Plan, and for the PUD and Development Agreement, the Specific Plan as well; and, conforms to <br />the PUD purposes; and, recommend approval, with modifications, as desired, by the Planning <br />Commission. <br /> <br />Mr. Roush noted that even if the Commission does not certify the EIR, the City Council desires that the <br />Commission provide a recommendation on the project, due to a pending appeal from the applicant. <br /> <br />Bruce Lymbum, Attorney, City and County of San Francisco, noted that scientific information has been <br />determined that Pleasanton has not created an immediate health hazard on the Bernal property from <br />radioactive materials. Mr. Lymbum noted that Mr. Widner's October 4, 1999 memorandum was <br />intended to replace in its entirety his previous September 20, 1999 memorandum. He stated that the <br />California Department of Health Services has confirmed that it will require no further testing of the <br />property at this time and that there will be no remedial or regulatory jurisdiction over the property. He <br />requested that the Commission listen to the applicant's report regarding the lack of health risk, that the <br />Commission vote to certify the EIR and vote on recommendations to provide to the City Council on the <br />project as a whole. He stated that the applicant concurs with staff's analyses, conclusions, <br />recommendations, and suggested modifications for conditions of approval. Further, that the applicant's <br />report clarifies issues previously raised in the EIR and that the sledge drying bed should be subject to <br />further testing at the time of grading and construction of activities. <br /> <br />Mr. Lymburn provided an overview of the qualifications of radiation experts, Lynn Anspaugh, Ph.D., <br />and John Auxier, Ph.D, CHP, and introduced the people who would provide the presentation on the <br />sampling and analysis plan findings to the Commission on the Bemal property. <br /> <br />Discussion ensued between the Commissioners and staff relating to clarification of the roles of the <br />experts. <br /> <br />John Auxier, provided a slide presentation and overview of the definition of radiation, radioactivity, <br />radioactive materials, and background radiation. He provided a demonstration of the equipment that <br />was utilized to provide radiological testing on the property. <br /> <br />Lynn Anspaugh, Ph.D., provided a slide presentation relating to maximum dose rates of specific <br />radionuclides and commented on the calculations utilized. He provided an overview of the standards for <br />plutonium, California Criteria for radionuclides in soil, and applicable standards for plutonium. <br /> <br />In response to an inquiry by Commissioner Kameny relating to future testing on the site, Mr. Anspaugh <br />responded that the Department of Health Services concurs that further investigation should be conducted <br />of the Bemal site prior to any further development being performed. <br /> <br />Planning Commission Minutes October 7, 1999 <br /> Page 3 <br /> <br /> <br />
