He noted that he would support the wording of the school condition as reconunended in the <br />staff report. <br /> <br />Commissioner Sullivan commented that the path has two different impacts on two different kinds of <br />neighbors. He noted that there are impacts on the life style of the rural community from the path and the <br />build-out of the North Sycamore plan. He noted that he would not have supported the path if he had <br />been on the Planning Commission when the plan was reviewed. He advised that the North Sycamore <br />plan has impacts on the city neighbors on San Carlos and San Juan, such as more traffic, more children <br />in the schools, and a more crowded city. He stated that a democratic process was used to try to mitigate <br />impacts by having amenities as part of the development, and part of the bargain for development rights. <br />He stated that the path was a very important part of the final agreement that was made. He suggested <br />that half of the path (a three-foot wide path) be built on Mr. Bozorgzad's property now, with the other <br />three-foot wide path being built on Mr. Bach's property later. He stated that he feels that this path would <br />provide less risk than walking down Sunol. <br /> <br />Commissioner Kumaran stated that staff has done a good job of reaching compromises on this project. <br />He noted that in terms of benefits it might be more ora benefit for those living on Sycamore than those <br />on San Carlos. He stated it appears to him that the compromise before them is a good solution, and, <br />therefore, supports staffs recommendation, in that it would retain the rural character of that <br />neighborhood, as long as it remains rural. He noted that the construction of the path could then be <br />considered when the property is developed. <br /> <br />Commissioner Kumaran advised that he supports staffs recommendations regarding the lot size, the <br />front yard setbacks, and the FAR ratios. He noted that with regard to condition #15, he would support <br />the applicant's request regarding the construction hours. He noted that he believes the FAR allows <br />sufficient leeway within the 20% to meet the applicant's house size requirements. He advised that he <br />would support Commissioner Robert's suggested change regarding the school condition. <br /> <br />Commissioner Sullivan noted that he believes that children from the Greenbriar area would use the path <br />to get to school. <br /> <br />A motion was made by Commissioner Roberts making the PUD findings, and recommending <br />approval of Case PUD-99-02, subject to the conditions listed in Exhibit "B," and the amended <br />conditions in staff's memorandum dated August 24, 1999, with the following modifications: <br /> <br />the design of the proposed houses shall come back to the Planning Commission for <br />review and approval; <br />construction can occur Monday through Saturday, while Greenbriar is under <br />construction, except for excavation and grading, which would have to occur <br />Monday through Friday; and <br />the Phoebe Apperson Hearst School has to be open prior to the owner occupancy of <br />the house on lot 4. <br /> <br />Discussed ensued regarding prohibiting excavation and grading on Saturdays for this project. <br /> <br />PLANNING COMMISSION MINUTES Page 19 August 25, 1999 <br /> <br /> <br />
