know when he might sell lots 1, 2, or 3, and those houses could be built long after Greenbriar is <br />completed. <br /> <br />Commissioner Maas stated that she would suggest that while construction is being done on Greenbriar <br />on Saturdays, construction on this application should also be able to occur. With regard to the path, she <br />stated that she would be comfortable with supporting what staff has provided the Commission with. She <br />noted that the Specific Plan would be satisfied and pretty much both sides of the people's feelings would <br />be satisfied. She stated that she would support staffs recommendation regarding the FAR and the <br />issuing of the building permits. <br /> <br />Commissioner Kameny stated that he concurs with Commissioner Maas with regard to her comments. <br />He advised if Greenbriar is working on Saturday, he does not see any reason why this subdivision should <br />not be allowed to work on Saturday. He stated that he would support staffs condition related to the <br />FAR. With regard to the path, he suggested that condition be reworded to read: "The construction of <br />the pedestrian path on the Bach property shall be the responsibility of the developer of the Bach property <br />and the exact location and timing for installation of the path shall be determined in conjunction with the <br />Bach PUD application and build-out." <br /> <br />Discussion ensued as to the appropriate wording regarding the timing of the installation of the path. <br /> <br />Commissioner Roberts stated that she would support the application. She noted that she would support <br />amending the specific plan to eliminate the trail at a future time, noting that a 600-foot trail between <br />properties sounds utterly ridiculous, and this is an urban/rural interface that she does not believe people <br />understand. She stated that she understands Mr. Bach's desire not to have the horses played with or <br />poked at. She noted that someone expressed the desire for children to have a way to walk to school <br />where there are lots of eyes on the road, but this trail at this point, would not provide that at all, in that <br />the homes are not there and this is a very rural area. She stated that this trail is not a bike trail, in that <br />there are stairs at the upper level, so it is limited to pedestrians. She advised that she would leave the <br />wording for the trail as it is. She commented that she would leave the FAR's at 20%, with the design of <br />the house to be dealt with later. She stated that staffs recommendation regarding lot 1, the agriculture <br />lot, to allow a barn outside of the FAR is a good one. She noted that she would like to change the <br />wording that the barn is only for animals, to allow the ham's use for any agricultural pursuit. She <br />advised that she agrees with the Monday through Saturday construction for lot 4, as long as Greenbriar is <br />under construction. With regard to the applicant's request related to the condition for the schools, she <br />suggested that the house on lot 4 cannot be occupied until the school is open. <br /> <br />Commissioner Sullivan stated that he agrees with staff regarding the conditions related to FAR and <br />setbacks, except for lot 4, in that he believes that a 6,973-square-foot house is too big and is out of <br />character with the older neighborhood and even with the 4,000-square-foot houses around it. He advised <br />that he would like the design review of the homes go to the Planning Commission, because of the issues <br />and sensitivity with this area. He stated that he supports staff's efforts in trying to save additional trees <br />by rerouting the driveway. He noted that he would like to see the trees which are being removed have a <br />value assessed, with that value charged to the developer and placed in a fund to plant more trees <br />somewhere else. He stated that he believes that would provide an additional incentive for developers to <br />try and save more trees.
