Commissioner Roberts amended the motion to delete the reference to "excavation and grading." <br /> <br />It was clarified that the intent of the school condition is to allow the owner/applicant to pull a building <br />permit for lot 4 prior to the school opening, but he could not occupy the home prior to the school <br />opening. <br /> <br />Commissioner Sullivan suggested that for trees which are removed in this development a valuation of <br />the tree should be done and the developer be required to pay the amount equal to the value of the tree to <br />an "in-lieu-of-tree-fee" fund. Ms. Seto advised that this is something that would need to come back in <br />the form of an ordinance as this is a requirement of the process prior to adopting any type of <br />development impact fee or development-related fee. <br /> <br />Commissioner Maas seconded the amended motion. <br /> <br />PUBLIC HEARING REOPENED <br /> <br />In response to a question from Mr. Bozorgzad, Chairperson Kumaran clarified that the intent is to allow <br />one building permit to be issued for a home that will be owner-occupied. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Roberts amended the motion to allow one building permit to be issued for a home <br />on lot 4 that will be owner-occupied. Commissioner Maas seconded the amended motion. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Kameny, Maas, and Roberts, and Chairperson Kumaran <br />Commissioner Sullivan <br />None <br />None <br /> <br />Resolution No. PC-99-57 was entered and adopted as motioned. <br /> <br />Commissioner Sullivan noted that he voted no for the reasons he stated previously. <br /> <br />The Planning Commission took a break at 12:15 a.m. The meeting was reconvened at 12:20 a.m. <br /> <br />Z-99-79, Kevin Best and the Panattoni Development Company <br />Application for design review approval of three, 30,000-square-foot industrial buildings on <br />a portion of a 19-acre site located at 3700 Boulder Street and approval of an Initial Study <br />and Negative Declaration for approximately 249,000 square feet of building area to be <br />located on the entire 19-acre site. The subject property is covered by the I-G-40 (General <br />Industrial) zoning district.
